All about Next Chief Justice of India, Justice Jagdish Singh Khehar

The government of India appointed the senior-most judge, Justice Jagdish Singh Khehar as the next Chief Justice of India on Monday after the recomendation from Justice TS Thakur, as per the media reports the President Pranab Mukherjee has cleared his name and a notification in this regards is being issued.


He will take oath on 4th January, 2017 after Justice TS Thakur's retirement on 3rd January, 2017.

Justice Jagdish Singh Khehar, 64, who currently led the Constitutional Bench of five judges in the Supreme Court had recently struck down the government National Judicial Appointments Commission Act, will be the first Chief Justice of India from the Sikh Community.

He had been awarded, Gold Medal for securing the first position in the LLM examination, by Punjab University, Chandigarh, where he was studying LLB and LLM.

Justice Khehar had been elevated as a judge in the Punjab and Haryana High Court. He had appointed as the acting Chief justice of Punjab and Haryana High Court between 2nd August, 2008 and 17th November, 2009. On 29th November, 2009 he was appointed as chief justice of Uttarakhand, later transferred as chief justice of Karnataka High Court. He was then first time appointed as judge of Supreme Court of India on 13th September, 2011.

The Justice Jagdish Singh Khehar will have a tenure of seven months till August 28, 2017.

A brief of his Judgement :

1. Struck down the Controversial Act, the National Judicial Appointments Commission.
2. Set aside the imposition of President’s Rule in Arunachal Pradesh in January 2016.
3. He was a also member of the bench in which Sahara chief Subrata Roy has been sent to jail, while hearing the matter of money refund invested by people in his two companies.
4. A significant verdicat had been also given by a bench led by Justice Khehar, the judgement said that the principal of “equal pay for equal work” must be given to daily wagers, casual and contractual employees.

While turf war between the judiciary and the executive over the appointment of higher judiciary judges has intensified, Justice Khehar responded to the tirade from Attorney General by making a statement that the judiciary was working within its "lakshmanrekha".

He also said Judiciary is mandated to protect all persons, citizens and non-citizens alike, against any discrimination and abuse of state power. The liberty, equality and dignity of the citizen have flourished in India because of the pro-active role of the judiciary in the country.
