Objecting to a Garnishment

If you have been served with a Garnishment and writ, and you decide to object it must be based on any one of the following


  • Funds or Property are Exempt
  • Bankruptcy is Pending
  • Barred by an Installment Payment Order
  • There is a Higher Priority Garnishment that is Taking the Maximum Amount
  • The Judgement has been paid
  • The Garnishment Was Not Properly Issued or Otherwise Invalid

You use Court Form MC 49, Objections to Garnishment and Notice of Hearing.
