Bose Headphones May Be Spying On You, Lawsuit Alleges

Audio giant Bose has been hit with a class action Lawsuit over its wireless headphones and speakers, according to Fortune.

Customer Kyle Zak’s filed a suit in an Illinois court against the Bose Connect app—the mobile application that pairs smartphones with Bose’s wireless speakers and headphones. The lawsuit alleges that Bose designed the app to collect private data from users—including the names of the songs and audio files they listen to—which is then sent to third-party companies without users’ consent.

According to the complaint, Bose created detailed profiles of customers’ listening histories and habits. The company then shared it with marketing companies, including a firm whose website promises to “collect all of your customer data and send it anywhere.” If true, this contravenes the Wiretap Act, the Illinois Eavesdropping Statute and a number of US state privacy laws.

Zak’s lawsuit is demanding damages, but doesn’t specify how much. He is also seeking an injunction to prevent Bose from collecting and distributing data.

Bose has responded to the allegations in a new statement earlier this week.

“We understand the nature of class action lawsuits. And we’ll fight the inflammatory, misleading allegations made against us through the legal system,” the audio company said in a statement on its website.

“For now, we want to talk directly to you,” the company said. “Nothing is more important to us than your trust. We work tirelessly to earn and keep it, and have for over 50 years. That’s never changed, and never will. In the Bose Connect App, we don’t wiretap your communications, we don’t sell your information, and we don’t use anything we collect to identify you — or anyone else — by name.

“If there’s anything else we think you should know, you’ll hear it straight from us,” Bose added.
