Job Description

Title: Staff Attorney Legal Support Specialist (Part Time)

Department: Resource Development

Reports to: Dustin Hardwick, Director of Resource Development

JOB SUMMARY

The Project will include providing legal support to water systems located in disadvantaged communities (DACs). The Project will target DACs, since DACs most often do not have the resources available to successfully design and implement proper drinking water solutions. The intent of this Project is to achieve measurable improvement in water quality and supply, more efficient water systems, and more stable and sustainable governance. Small water districts and mutual water companies that serve disadvantaged communities often lack training and experience in regulatory compliance and long-term system sustainability. They also suffer from contaminated and compromised water quality, and lack skills or staffing to secure federal and state funding via grant and loan programs. The Project will provide technical assistance and support to help with all stages of project development.

The Project service area is statewide.

SUMMARY OF ESSENTIAL JOB FUNCTIONS

The Staff Attorney Legal Support Specialist will offer legal assistance in the following areas as needed:

Corporate Compliance Reviews - legal counsel will assist in the review of compliance with applicable federal and state laws and regulations, as well as compliance with system rules and regulations.

Boundary Analysis - legal counsel will review boundaries to ensure compliance with organizational documents, local agency formation commission records and spheres of influence, and to avoid duplication of services.

Review of Bylaws - legal counsel will review bylaws for compliance with legal requirements, stakeholder interests, appropriate governance, and shareholder rights and obligations.

Ordinances - legal counsel will assist water districts in drafting ordinances and resolutions appropriate to governance, compliance, finances, and water service.

Land Acquisition and Agreement Negotiation - legal counsel will assist water districts with land acquisitions and agreement negotiations as needed.

General Legal Support- Small systems encounter a variety of legal challenges, that need the guidance and support of an attorney to help resolve. This can include water rights, to current pending litigation matters.

Physical Demands:

Travel for extended periods of time throughout the state by car or airplane

Ability to lift 20lbs or less

Sitting, standing or walking for long periods of time

Use of office equipment, i.e., computers, fax, copiers, phone equipment, etc.

Hearing and vision within normal ranges with or without correction

MINIMUM REQUIREMENTS

BA preferred

Juris Doctor Degree JD

Successful passing of CA State Bar Exam

Minimum of 1 year legal experience

CA Driver's License

Access, Excel, Word, Outlook, Typing

Good oral communication skills

Ability to adapt to change, learn new skills rapidly and respond well to a variety of personalities.
