Buying an RV is not like buying a car. It is a big decision, and one should go into it without knowing all of your RV Consumer Rights. With time, RVing is getting increasingly popular, meaning more and more people are buying new RVs and hitting the road. Purchasing and taking ownership of an RV can be challenging and confusing for a first-time RV buyer. Therefore, it is imperative to understand how to buy an RV and prepare for the RV lifestyle without any potential issues.

There is no doubt that it comes with RVing, and we love the freedom and ease of spontaneous travel as it suits our travel lifestyle. To avoid potential stress and frustration, we must know and be aware of our rights as RV buyers, besides knowing dealers’ obligations.
Below are the few rights which are for RV owners and Buyers as consumers in general and particularly for US Citizens:

The right to purchase an RV free of defects

As an American citizen, it is your right to buy/have an RV free of defects. It is because of a dealership or a manufacturer’s warranty issuance as they get your RV repaired when needed.

The right to timely repairs

You can have your RV repaired quickly after purchase until and unless predetermined on the contract. As a manufacturer or dealer agrees to repair your vehicle, you should not be deprived of your RV for extended periods.

The right to evidence

In case your RV undergoes repair, it is your right to have all proof regarding that repair, such as invoices or receipts documenting the repairs issued on your RV.

The right to compensation

As an American citizen, you have a right to be compensated when you purchase the RV but are deprived of its use and enjoyment of purchase. Reasons can be an extended period in the repair shop or if your RV has been out of service for excessive time.

As an RV buyer and owner, one should also know about their RV consumer rights under federal laws and acts that protect them.

Motor Vehicle Dealers Act (MVDA)

If a motor home vehicle (drivable RV) is purchased from a registered dealer, you are protected by OMVIC and MVDA. In case of encountering a problem or an issue with the dealership, OMVIC can help because of the Motor Vehicle Dealers Compensation Fund.

Consumer Protection Act (CPA)

In case certain purchases, including RVs if not covered by the MVDA, they may still be protected by the CPA, which is administered by the Ministry of Government and Consumer Services. Under CPA, important protections offered to consumers are contracting cancellation rights should the business make a false, misleading, deceptive or unconscionable representation.

Magnuson Moss Warranty Act

It is a federal law which guards consumer product warranties. Where local and state laws do not offer protection against faulty RV, this federal law does so.

Sale and Supply of Good Consumers Regulation 2002

It is the Updation version of the Sales of Goods Act 1979 in Europe, under which now the seller/dealer has either to repair or replace the vehicle if it is defective. A few other options and ways out of this regulation include entitled to price reduction, entitled to return the vehicle and get the money refunded, and if a major inconvenience is caused by repairing or returning the vehicle, the money can be refunded. Under this regulation, courts can now force manufacturers or dealers to live up to their guarantees and warranties. This includes RV consumer rights.

California Lemon Law

If you live in California, the California RV Lemon Law is a consumer protection statute designed to safeguard the rights of individuals who purchase or lease recreational vehicles (RVs) in the state. You can have this California lemon laws apply to RVs, incldingies to motorhomes, campers, and trailers, and it offers legal recourse to buyers who find themselves stuck with defective or malfunctioning RVs.

Dealers Obligations- Consumers’ Rights

Details should be mentioned while communicating with the dealers and why they should compensate you. As a buyer, it is within your RV consumer rights to ask the dealer from whom you are buying an RV to test the systems, including running water, water heater, water pump and all the electrical outlets, as regards their working and functionality. A dealer must ensure that all system of an RV is operational, functional and working before selling and handing it over to the buyer.

Taking ownership

As a buyer, it is within your RV consumer rights to only take over the ownership of the RV if it is in tip top operating condition or if you are unsatisfied with the dealer not giving you a complete walk through. As it is the obligation of a dealer not only to provide you with a thorough walk through but also to hand you over an RV with fully operating systems.
