Littler Mendelson Hires Former EEOC Chief Counsel Bradford Kelley

Labor and employment law firm Littler Mendelson has announced that it has hired Bradford Kelley, former chief counsel to Commissioner Keith Sonderling at the U.S. Equal Employment Opportunity Commission (EEOC). Kelley will join Littler as a shareholder in Washington, D.C.

During his time at the EEOC, Kelley provided advice on federal employment anti-discrimination laws and the EEOC’s Artificial Intelligence and Algorithmic Fairness Initiative, which ensures compliance with civil rights laws in the use of AI. Littler stated that the increasing use of AI by human resource and management teams has led to greater scrutiny of its use in hiring and employment practices.

Commenting on Kelley’s hire, Littler president Erin Webber stated that his guidance will be invaluable to clients in terms of regulatory compliance and understanding the impact of AI in the workplace and employment law.

Kelley expressed that the growing importance of AI influenced his decision to move to private practice but emphasized that he plans to have a broad-based practice at Littler. Prior to his work at the EEOC, Kelley served as a policy advisor with the Wage and Hour Division of the U.S. Department of Labor, focused on matters related to the Fair Labor Standards Act and the Family and Medical Leave Act.

Kelley’s interest in emerging technologies like AI developed during his time as an infantry and intelligence officer in the U.S. Army, where he observed the impact of technology on society.
