Legislation Introduced to Protect Workers from Artificial Intelligence in the Workplace

U.S. Sen. Bob Casey, D-Pa., has proposed two bills in an attempt to address the potential negative consequences of artificial intelligence (AI) in the Workplace. The first bill, known as the “No Robot Bosses” Act, seeks to protect employees and job applicants from automated decision-making software. It also requires employers to disclose how and when they use such systems.

According to Casey, technologies like ChatGPT are already being utilized to make critical decisions in the workplace, including interviewing and hiring candidates, promoting or disciplining employees, and even terminating workers. Without oversight, these “robot bosses” increase the risks of discrimination, unfair treatment, and unsafe working conditions.

The “No Robot Bosses” Act would prohibit employers from relying solely on automated systems for employment-related decisions. It would also require testing for issues such as discrimination and biases, and the implementation of human oversight when using automated decision systems in employment-related matters.

The second bill introduced by Casey, called the Exploitative Workplace Surveillance and Technologies Task Force Act, aims to establish a task force led by the Department of Labor and the Office of Science and Technology Policy. This task force would study the impact of automated decision-making systems and workplace surveillance.

Sen. Casey, along with Sens. Brian Schatz, D-Hawaii, and Cory Booker, D-NJ, highlight the need for research and investigations into how employers are utilizing algorithms and automated decision systems to surveil employees and make determinations about their employment. They also mentioned the lack of understanding surrounding the potential misuse of collected data and how it may violate workplace anti-discrimination regulations.

The proposed legislation not only addresses the need for transparency and accountability in the use of AI and automated decision-making systems but also seeks to protect the rights and well-being of employees in the workplace.

By introducing these bills, Sen. Casey and his colleagues are taking steps to ensure that the potential harms of AI and automated systems are mitigated. These bills aim to create a fair and safe working environment where employees are not subjected to unfair treatment or discrimination due to automated decision-making.

As AI continues to play a larger role in the workplace, it is crucial that regulations are put in place to safeguard the rights and well-being of workers. The proposed legislation serves as an important step towards achieving this goal.
