Meta sued in Kenya for poor working conditions – JURISTA

A former Facebook moderator filed a lawsuit Tuesday in the Kenya Labor and Employment Tribunal against Facebook’s parent company, Meta, for poor working conditions. The lawsuit was filed on behalf of a group of contract moderators who work for Sama, a multinational company that services numerous websites, which is also named in the lawsuit. It alleges that content moderators hired in Kenya are subject to unreasonable working conditions and unfair labor practices. This includes forced labour, mental injuries, union busting and violations of the rights to privacy and human dignity under the Kenyan constitution. He is also seeking an order that recognizes contract moderators as employees of Meta, ensuring that contract moderators have the same health care and pay scale as other Meta employees. In addition, he demands a human rights audit of the office and that Meta be forced to defend union rights. The former employee, Daniel Motaung, stated that “Sama and Meta acted negligently. They failed to provide adequate precautions for safety and mental well-being, exposing workers to risk, danger and injury.” However, Motaung is the only employee to provide evidence in the lawsuit, as other employees were forced to sign confidentiality agreements at the beginning of their employment with Sama. According to local experts, the demands of the demand could reverberate beyond Kenya. Odanga Madung, a member of the Mozilla foundation, said: “This could have a ripple effect. Facebook will have to reveal a lot about how they run their moderation operations.”
