EU bodies agree landmark internet law regulating online content – JURIST

The European Council (EC) and the Parliament of the European Union (EU) reached a provisional political Agreement on Saturday on the Digital Services Act (DSA), a landmark internet law proposed by the EC in 2020. The DSA has the intention to prevent the circulation of illegal digital data. content and to protect the Fundamental Rights of users by requiring online intermediaries such as Meta and Google to actively moderate digital content and undertake extensive due diligence and compliance measures. These measures include transparency reports, terms of service that duly take into account the fundamental rights of users, cooperation with national authorities, establishment of complaint and redress mechanisms, and external auditing. The agreement allows the DSA to subject large online platforms and search engines to level-level oversight mechanisms in cooperation with EU member states and in accordance with the country of origin principle, impose a duty of care on markets online by requiring them to collect and display information on the products and services sold in the interest of the consumer and obliging intermediaries to carry out annual analyzes to reduce systemic risks associated with content that has potentially adverse impacts on the fundamental rights of users, democratic processes, public security, gender violence or physical and mental health. personal data as defined in EU law and expands the coverage of the DSA to ban deceptive digital user interfaces known as “dark patterns” intended to trick users into sharing personal information with companies. European Commission President Ursula von der Leyen praised the agreement, saying: The Services Law is historic, both in terms of speed and substance. The DSA will update the basic rules for all online services in the EU. It will ensure that the online environment remains a safe space, safeguarding freedom of expression and opportunities for digital business. It gives practical effect to the principle that what is illegal offline should be illegal online. The larger the size, the greater the responsibilities of online platforms. Today’s agreement, which complements the political agreement on the Digital Markets Law last month, sends a strong signal: to all Europeans, to all EU companies and to our international counterparts.
