Texas GOP Rep. Fallon sues to impeach Majorcas national security over border crisis

WASHINGTON. Sherman Rep. Pat Fallon filed articles of Impeachment accusing Homeland Security Secretary Alejandro Majorcas of shirking his duties to protect the Border.

The twice-elected Republican’s resolution, filed late Monday night, is the first official attempt to remove anyone from the Biden administration since the Republican Party took control of the House of Representatives last week.

It was hardly a surprise. Republicans have long sought the scalp of Mallorcas, accusing him of not doing his job well.

“From giving false testimony before Congress about maintaining operational controls on the border to the infamous slander against our Border Patrol Agents, Secretary of State Majorcas has proven time and time again that he is not fit to lead the Department of Homeland Security,” Fallon said via an aide. “His deliberate actions undermine our immigration system, undermine the morale of the border guards, and endanger US national security. He should be removed from office.”

“Whipgate” refers to a clash near Del Rio, Texas in which border patrol agents on horseback beat Haitian migrants. Biden promised a quick punishment when the photo surfaced in September 2021. But later there was information that Mallorcas had been told in advance that the photographer had not witnessed the flogging, and the photo was misleading.

Asked Sunday about demands for his impeachment as he flew with Biden to El Paso aboard Air Force One, Mallorcas said he was focused on “getting the job done that we need to get done.”

One of the articles in Fallon’s impeachment resolution accuses Majorcas of failing to maintain “operational management” of the border as required by law, as evidenced by the fact that 5.5 million people crossed the border illegally during his tenure.

The article also mentions the department’s refusal to detain every migrant it captures, although to varying degrees, presidents of both parties have always argued that the government has discretion to release migrants before a hearing, especially since Congress has never allocated enough resources to detain. 100% caught.

Article II accuses Majorcas of giving false evidence to Congress that he believes the border is under operational control.

Article III alleges that he “deliberately slandered” the Border Patrol agents in the “knutgate” incident.

Senator Ted Cruz and other Republicans have been demanding his impeachment for months on the grounds that his mismanagement led to record levels of illegal immigration and outbreaks of smuggling of migrants, fentanyl and other smuggling.

“I have a lot of work to do and I intend to keep doing it. This is my answer,” he said. Dallas Morning News editors in October when asked about the prospectus.

A removal from office is extremely unlikely even if the House of Representatives, which has been under tight Republican control since January 3, approves the articles of impeachment.

The two trials of Donald Trump served as a reminder that even if the opposing side controls the House of Representatives, the Senate controls the outcome of the impeachment. It would take two-thirds, or 67 out of 100 senators, to condemn and remove Mallorcas. And Republicans control only 49 seats.

Fallon’s resolution has so far failed to attract cosponsors, and it’s unclear if it will be the vehicle the GOP leadership will use to impeach Majorcas. The case has been referred to the Judicial Committee.

The House of Representatives can approve articles of impeachment by a simple majority vote.

Republicans control the House with five votes. That means a handful of moderates could thwart an impeachment, as 20 far-right lawmakers managed to thwart Speaker Kevin McCarthy’s ascent to the top office last week.

McCarthy does not intend to openly impeach Mallorcas. He echoed the sharp rhetoric questioning the Secretary of State’s work and vowing to investigate border security lapses since President Joe Biden took office two years ago next week.

“You have to build a business. you need facts [and] evidence before indictment,” Rep. Michael McCall, an Austin Republican, told The Hill. McCall, the former chairman of the House of Representatives for homeland security, added: “He didn’t neglect his duties? I think so.”

Majorcas was in Mexico City with Biden for a summit with the leaders of Mexico and Canada.
