UCC to include divorce, not marriage customs: Report


- Will exclude same-sex marriages from the purview of the UCC

- There is no possibility of organizing one nation one election in the country before 2029: Law Commission

New Delhi: The Law Commission has handed over its report to the Central Government while the discussion is going on to implement the Uniform Civil Code before the next Lok Sabha elections in the country. According to sources, the Uniform Civil Code (UCC) will not touch on laws related to marriage while it will focus on laws like divorce, maintenance, succession.

Ahead of the upcoming Lok Sabha elections, the Law Commission had sought suggestions from the public on the draft of the Uniform Civil Code in July-August, when the country was being debated about implementing a Uniform Civil Code. Now the Law Commission has submitted its report to the Central Government. According to sources, only one man and one woman will be mentioned in the context of marriage. Same-sex marriages are not legally sanctioned. Moreover, the customs of various religions regarding marriage are not touched in the UCC. However, the focus will be on related laws like divorce, maintenance, succession. Apart from this, sources have said that the Law Commission has opposed polygamy, Nikah Halala, monogamous talaq etc.

While the 'One Nation One Election' debate has gained momentum since the announcement of a special session in the New Parliament House in the capital New Delhi, the Law Commission on Friday made it clear that 'One Nation One Election' is not possible in the country before 2029. Despite the discussions that the Central Government has formed a committee for 'One Nation One Election' and this committee has also started its work, according to the report of the Law Commission, it is more likely that the Lok Sabha and Assembly elections will be held simultaneously from the year 2029. The Law Commission says that one nation, one election is not possible in the 2024 Lok Sabha elections. Specifically, the Law Commission's report deals only with Lok Sabha and state assembly elections. It does not mention local Swaraj elections like municipality, municipality, panchayat, sources said.
