The Supreme Court reserved judgment on the petitions challenging the 10 percent EWS reservation

The Supreme Court has reserved judgment in the case of 10 percent reservation to IDBUS in higher education. The hearing was on petitions challenging the legality of the 103rd Amendment to the Constitution, which provides 10 per cent reservation for economically weaker sections in admissions to educational institutions and government jobs.

A five-judge constitution bench headed by Chief Justice U U Lalit heard arguments from attorney general KK Venugopal and solicitor general Tushar Mehta and other senior lawyers.

It then ruled on the legal question whether the EWS quota violated the basic structure of the Constitution or not. The Supreme Court heard in this regard for six and a half days.

Earlier in the hearing held on September 13, academician Mohan Gopal had opposed the EWS quota. On the final day, the petitioners' lawyers responded to the central government's arguments.

Besides Chief Justice UU Lalit, the constitution bench included Justice Dinesh Maheshwari ,Justice S Ravindra Bhat ,Justice Bela M Trivedi and Justice JB Pardiwala.

On the other hand, senior advocates Ravi Verma Kumar , P Wilson , Meenakshi Arora , Sanjay Parikh , KS Chauhan and Advocate Shadan Farasat were present inthe hearing of this case . Senior advocate Shekhar Naphade was present on behalf of Tamil Nadu. He opposed the EWS quota.

It may be mentioned that the bill regarding EWS quota was passed in Lok Sabha and Rajya Sabha in 2019. The EWS quota is higher than the existing 50 percent (SC , ST and OBC) reservation.
