Liquor policy case: Delhi high court rejects Arvind Kejriwal’s plea challenging his arrest by ED

Chief Minister Arvind Kejriwal’s appeal against his arrest by the Enforcement Directorate (ED) in the excise policy case was denied by the Delhi High Court on Tuesday.

The central agency had sufficient evidence, according to the high court, to justify Kejriwal’s arrest. Those who were detained were also impacted by the chief minister’s delay.

The high court said, Kejriwal’s non-joining was a contributory factor & not the only factor.

According to the court’s order, doubting or casting aspersions the way the approver’s statement was recorded is similar to slandering the judge and the court.

The court further said that Sarath Reddy and MS Reddy made their statements voluntarily. Cannot step into the shoes of trial court & conduct a mini trial, the court said.

The High Court judge said, the petitioner was arrested in a case involving money laundering, and the courts must take this into account in light of the law even though the arrest was not timely. Kejriwal would have been quite busy after learning when the Lok Sabha elections would be announced. The high court judge also said, it cannot be held that the timing of the arrest was determined by ED.

The court further said that as political factors and equations have no bearing on court processes, they cannot be expanded in the law. It also said, the petitioner and the ED are the parties involved in this matter, not the Centre and Kejriwal.

Meanwhile, Delhi Minister Atishi claimed that Arvind Kejriwal would be released from jail in a day if he chooses to join the BJP. During her  three-day journey to Assam to support AAP candidates for the Lok Sabha seats in Dibrugarh and Sonitpur, Atishi also made disparaging remarks against Assam Chief Minister Himanta Biswa Sarma. She sai The Delhi CM would be released from jail in a day if he joined the BJP, much like Himanta Biswa Sarma did.

The AAP minister said Kejriwal is a fighter, whether he is in jail or not, he will not give in to the pressure of the BJP and will carry on serving the people of Delhi, Punjab, and Assam.
