Delhi man to get Rs 50 lakh from travel agencies after his wife, son died during Srilanka trip

Delhi man, who lost his wife and son during the Srilanka trip to get the compensation of Rs 50 lakh after the Consumer Disputes Redressal Forum directed Thomas Cook and Red Apple Travel Agencies to pay the amount to the victim’s family member.

A former journalist with a national news channel, Kanupuriya Saigal, died in the December 2019 accident. The van that they were travelling in collided with a container truck in Colombo, resulting in the death of her son Shreya Saigal and her father, the well-known Hindi litterateur Ganga Prasad Vimal. Along with that, the accident claimed the life of the 52-year-old van driver. Her husband Yogesh Saigal and their daughter Aishwarya Saigal, had sustained severe injuries.

Yogesh Saigal was given compensation almost four years later when the Consumer Disputes Redressal Forum directed the travel agencies to pay.

The Forum stated that Thomas Cook and Red Apple Trave are responsible for the negligence of the driver they hired and cannot deny their liability by saying that they were only making bookings on the complainant’s behalf.

After negligence from Thomas Cook and Red Travel, the Saigal family went to Forum against them. In the complaint, the family said that the travel agencies have shown misleading advertisements and unfair trade practices. They asked for 8.99 crore compensations from the agencies, as per the reports.

The Kanupriya’s husband said he had been unable to attend the funeral and last rites of his wife and son, which took place in Delhi, as he had suffered multiple fractures and was recovering at a hospital in Sri Lanka. The loss of his wife and father-in-law has hit his mother-in-law hard as she is physically and mentally challenged. He further said, his daughter is battling severe mental trauma. He is unable to walk normally and finds it difficult to sleep or interact socially.  

The Forum has directed to pay Rs 50 lakh compensation to the victim and said it has to be paid by the travel agencies jointly and severally within three months, failing to do so will land in paying another 10 lakh.
