Samajwadi Party leader Azam Khan convicted in hate speech case

Senior Samajwadi Party leader Azam Khan has been convicted in connection with 2019 hate speech case. He was found guilty in the case filed against him over the remarks against Uttar Pradesh Chief Minister Yogi Adityanath and the then District Magistrate Aunjaneya Kumar Singh. Khan and two other accused were sentenced to three years in jail along with a fine of Rs. 2000.

On September 28, Rampur Superintendent of Police (SP) Ashok Kumar said that there was a case in a local court against Azam Khan over an alleged 2019 hate speech. The trial was in final stages and the verdict was expected soon. Azam skipped appearances on September 17, 19, and 23, saying he could not come since he had a heart surgery. The court then formed a committee headed by the Chief Medical Officer to assess whether he was fit to come to court or not. Azam’s lawyer was then asked to share his whereabouts. But the lawyer said he did not know where Azam was.

He further said that it was up to court to decide what action to take. They would follow the court’s order.

The hate speech case was registered against the SP leader at Milak Kotwali in Rampur, Uttar Pradesh on April 9, 2019 for alleged provocative remarks against Yogi Adityanath and the then District Magistrate Aunjaneya Kumar Singh under sections 153 A (promoting enmity between two groups), 505 (1) (statement conducing to public mischief) of the Indian Panel Code (IPC) and section 125 of the Representation of People Act, 1951.

Earlier, the Supreme Court granted him interim bail in a forgery case in May this year. The court directed him to file an application for regular bail before the competent court within two weeks.

The three-judge bench of of Justices L Nageswara Rao, BR Gavai and Bopanna granted bail to senior SP leader exercising its power under Article 142 of the Constitution.

In another bail plea filed by Azam Khan PS Kotwali, the interim bail was also granted him. Earlier, the bail was denied to Azam Khan by the Special Court.
