Delhi High Court dismisses PIL seeking removal of Satyendar Jain

The Delhi High Court on Thursday dismissed a Public Interest Litigation (PIL) that sought suspension of Satyendra Jain from the cabinet. He belongs to the Aam Aadmi Party (AAP). 

The plea was presented by Nand Kishore Garg (former MLA of the Delhi constituency) through Advocates Shashank Deo Sudhi, Dinesh Kumar Dakoria, Sachin Sain and Aman before a judicial bench comprising Justice Satish Chandra Sharma and Justice Subramonium Prasad.

The plea seeks Jain’s suspension as he is serving judicial custody relating to a money laundering case and serious charges have been pressed against him.

As per the petitioners, Jain is enjoying all the benevolence of his ministerial chair despite the fact that an FIR was registered by the CBI under the provisions of the Prevention of Corruption Act, which is unfair. He had been accused of laundering assets that did not account for his income sources, during the period between February 2015 and May 2017.

The Chief Minister has provided Jain with a certificate of exoneration despite him still being under judicial custody and has been held incompliant with the supremacy of his oath by the petitioners. 

The petition also seeks well-formulated guidelines to regulate the suspension and dismissal of a minister in case he is subjected to judicial custody for a period exceeding 48 hours. 

Eventually, the Delhi High Court dismissed the petition owing to their inability to travel beyond the provisions of statutes, rules and notifications.
