President Rodrigo Duterte has approved a bill guaranteeing government employees, including those in Government-Owned or Controlled Corporations, night Shift Differential Pay (GOCC).
Government personnel must be paid a night shift difference at a rate not exceeding 20% of their hourly base wage, according to Republic Act 11701. Division heads and below, or their equivalents, are covered, as are those in GOCCs, regardless of whether their job is permanent, contractual, temporary, or casual.
The night differential pay will be determined by the head of the agency for each hour of work performed between the hours of 6:00 p.m. and 6:00 a.m. the following day, provided that the night shift differential pay provided under the law will be in addition to and will not in any way diminish whatever benefits and allowances government employees currently enjoy.
According to the law, the hourly basic rate is calculated by dividing the basic monthly rate by 22 working days and then dividing the quotient by eight hours.
Monthly basic rate: ₱20,000
₱20,000 / 22 = ₱909
₱909 / 8 hours = ₱113 per hour night differential rate
