Triple Talaq Draft Law: Non Bailable Offence, 3 Years Jail Term For Erring Men

The central government has already finalized the draft law on Triple Talaq issue. As far as the latest updates are concerned, Triple Talaq will be a cognizable and non-bailable offense. The draft law says that a victim of instant divorce can seek the custody of her minor children as well as maintenance from her husband by approaching a magistrate after registering a complaint with the police. 3 year for imprisonment has been assigned to erring men in triple talaq complaint.

Under the existing law, Triple Talaq in all forms, be it spoken, writing or in any electronic form would be banned. The draft was prepared by an inter-minister group. The group was headed by Home Minister Rajnath Singh and other members including Sushma Swaraj, Arun Jaitley, Ravi Shankar Prasad and PP Chaudhary took an integral part to the draft law.

Although the Supreme Court gave a verdict citing Triple Talaq to be unconstitutional and illegal, there are still complaints coming from various quarters. Thus, the concerned draft law is expected to change the Triple Talaq scenario and bring equality in Muslim societal structure. No doubt, existing laws under provisions of the Domestic Violence Act were of little help to the victims. Nevertheless, Prime Minister Narendra Modi deserves much praise for his states like attitude in this regard.
