Is The Supreme Court Insensitive With Regard To The Plight Of The Kashmiri Hindu Pandits?

Can you name any countries where inhabitants live like refugees in their own country? Well, the answer is simple and we are well aware of the state of Kashmiri Hindu Pundits. Unfortunately, the Supreme Court of India has failed to acknowledge it. Quite surprisingly, the Supreme Court has rejected the second plea of the Kashmiri Hindu Pandits for an investigation into the mass killing of community members in the late 80s. The mass killing has resulted in a mass exodus of Kashmiri Pandits from the Valley and growing hate for Indian democracy from the local Muslims. It is indeed shocking that the Supreme Court bench of Chief Justice Dipak Misra and D Y Chandrachud didn’t give a nod to the review plea filed against the rejection of the earlier petition of Kashmiri Pundits on July 24. Incidentally, the Kashmiri Pandits are legally fighting under the banner ‘Roots In Kashmir’. Previously, the Supreme Court rejected the plea just because the incident occurred 27 years ago. It is not only a case of bad precedence but a blot on Indian democracy that Kashmiri Hindu Pundits are not being accorded with basic human rights. The bipolar approach of Supreme Court while observing cases concerning Rohingya Muslims in contrast to the plight of Kashmiri Hindu Pundits has been the highlight.

Although much was expected in the Narendra Modi era, destabilizing forces are still active in Kashmir with their stone pelting operation in direct conflict with the armed forces. One can only say that the Narendra Modi government needs to find a feasible solution for the Kashmiri Hindu Pundits who are refugees in their own country.
