Are Surprise Inspections in a HOA Legal?

Associations are also allowed access to abandoned units for Inspection and any repairs of common elements to maintain the face of the development for the sake of the whole community. They are also allowed inside to check for presence of mold or deterioration, ensure all utilities are running smoothly, and maintain common elements regularly as is the case for the other units.
Surprise inspections are not mentioned anywhere in the statutes, unless under governing documents for a particular HOA. The association has to have a legitimate reason for entry into a unit and communicate to the homeowners the date of inspection early in advance for planning.
