One Dead and 22 Injured as Car Rams Into Pedestrians in Times Square

On Thursday, May 18, 2017, one person was killed and at least 12 others were injured when a car drove the wrong direction for three blocks, striking multiple pedestrians until its final crash and burn at West 45th street and Broadway. A 26-year-old man, with two prior arrests for driving while intoxicated, was driving the car and attempted to flee on foot but was detained by the police. The NYPD and multiple news stories have stated that he was intoxicated and even attempted to punch the officers as they were detaining him.
NBC has reported that a total of 20 people were hit by the vehicle and at least four survivors were taken to hospitals in critical or serious conditions. The number of victims is expected to rise as law enforcement agencies coordinate their rescue efforts.
The Attorneys and Staff at Linden Law want to send our hopes and prays to the families of the victim and survivors.
Accidents Involving Drunk Drivers and Pedestrians.
A drunk driving auto accident can happen anywhere, even during lunch hour in Times Square, directly outside your office. According to the FBI, over 1.4 million people were arrested in the US in 2010 for driving under the influence of alcohol and narcotics. In 2010, 23% of drivers of passenger vehicles involved in fatal crashes had a blood alcohol content of .08 or higher.
Driving while intoxicated is a dangerous event that not only puts a driver at risk but also risks the lives of innocent individuals around him. The New York City Personal Injury Attorneys at Linden Law have represented individuals who have been severely injured or lost family members due to the negligent and reckless behavior of drunk drivers.
A thorough understanding of the laws surrounding a claim of Drunk Driving is essential for a successful recovery in your case. Often, drunk drivers who cause an accident may have insufficient insurance coverage to fully compensate for the damage incurred. In New York, an attorney must determine whether others could be responsible for the accident, aside from the drunk driver.
In New York, the General Obligation Law Section 11-101() (Dram Shop Act) states that an individual who has been injured or killed by an intoxicated person may recover monetary compensation from the server or seller of alcohol if it can be shown that the intoxicated person who caused the injury was “visibly intoxicated” when served alcohol. The Alcohol Beverage Control Law Section 65(2) makes it unlawful for anyone to sell, deliver, or give alcoholic beverages to any “visibly intoxicated” person.
