WORKERS’ COMPENSATION CLAIMS

Workers’ Compensation is a system that provides benefits to employees who suffer injuries or become ill as a result of their job. Medical expenses, lost wages, and rehabilitation costs are usually the benefits associated with workers’ compensation.

Workers’ compensation laws vary from state to state, but the basic idea is to provide employees with a means of recovering from job-related injuries or illnesses without having to go through the lengthy and uncertain process of a personal injury lawsuit.

In the United States, legislature considers workers’ compensation a no-fault system. This means that an employee does not have to prove that their employer was at fault for their injury or illness in order to receive benefits.

Rather, the employee simply has to prove that their injury or illness was job-related.

INJURIES THAT WORKERS' COMPENSATION CAN COVER

There are many different types of job-related injuries and illnesses that are covered under workers’ compensation laws. Some of the most common include:

  • Physical injuries, such as broken bones, cuts, and bruises

  • Repetitive strain injuries or repetitive stress injuries (RSI) including back pain and carpal tunnel syndrome

  • Illnesses caused by exposure to toxic substances, such as asbestos or lead

  • Mental health conditions, such as depression and anxiety, that are caused by job stress

WHAT YOU SHOULD DO AND EXPECT FOLLOWING A WORKERS' COMP CLAIM

In order to receive workers’ compensation benefits, an employee typically must report their injury or illness to their employer as soon as possible.

The employer will then initiate the workers’ compensation claim process, which may involve obtaining medical treatment and providing the necessary documentation to the workers’ compensation insurance carrier.

In some cases, the employer and the employee may disagree about whether the injury or illness is job-related or whether it entitles the employee to benefits. In these cases, they may resolve the dispute through a hearing before a workers’ compensation administrative judge or through mediation.

It is important to note that workers’ compensation is typically the exclusive remedy for employees who suffer an injury or become ill as a result of their job. This means that employees are generally not able to sue their employer for additional damages in a personal injury lawsuit.

However, there are exceptions to this rule, such as in cases of intentional employer misconduct or where the employer does not have workers’ compensation insurance. There are many benefits to the workers’ compensation system.

For employees, it provides a relatively quick and efficient way to recover from job-related injuries or illnesses without having to go through the lengthy and uncertain process of a personal injury lawsuit.

For employers, it provides a way to protect themselves from costly personal injury lawsuits and helps to ensure that employees are able to receive the medical treatment and other benefits that they need to recover from their injuries.

However, the workers’ compensation system is not perfect. Some employees may have difficulty obtaining the medical treatment and benefits that they need, particularly if their employer or the workers’ compensation insurance carrier disputes their claim.

In some cases, dissatisfaction may arise among employees on behave of the benefits that they receive, as workers’ compensation benefits are typically lower than what an employee might receive in a personal injury lawsuit.
