CAR DRIVER STRUCK BY HGV AT TRAFFIC LIGHT JUNCTION RECEIVES PERSONAL INJURY COMPENSATION FOR HER INJURIES

Our client was a car driver travelling along a road in the middle of three lanes of traffic approaching traffic lights which were red.  As the traffic lights turned green and our client pulled away to cross the junction, the lorry driver in the left lane manoeuvred his vehicle towards our client, as his lane had ended and in doing so the front of the HGV collided with the rear of our client’s vehicle.  She sustained injuries to her neck and lower back and suffered symptoms from her injuries for just over a year following the accident, requiring physiotherapy treatment to assist her recovery.  We were able to recover Personal Injury Compensation for her of £5,000.

A brief summary of events is set out below.

Date of Accident:  April 2013

Time between formal instruction and successful conclusion:  We took on the case at the beginning of 2014 and managed to settle it in May 2015.

How the claim proceeded: Once we had taken full instructions from our client and explained the claim’s process, we contacted the opponent with our claim.  They would not give us a decision on liability initially, but did make a very low offer of Financial Compensation to our client.  We had subsequently arranged for our client to see a medical expert, who compiled a report detailing our client’s injuries, symptoms and prognosis, which enabled us to value her claim for financial compensation.  Our valuation figure was much higher than that offered by the opponent, so we contacted them with an increased counter offer that our client would be willing to accept, but they were not prepared to increase their initial offer.

Were Court proceedings necessary?:  Yes, as we were unable to negotiate a financial compensation settlement for our client with the opponent, we had no option but to commence court proceedings.

Was a trial necessary?:  No.  We had a court hearing date set to go ahead in June 2015 and just four weeks prior to this, we were contacted by the opponent’s solicitors with an increased offer of financial compensation for our client, much closer to our original valuation and one which she was happy to accept.

Outcome:   The client secured £3,500 for her injuries and £1,500 for her financial losses, including the repair of her vehicle, reimbursement of her car insurance policy excess and medication required for pain management during her recovery.

Comment:  In this case, the lorry driver was clearly negligent, as he failed to manoeuvre his HGV safely from one lane of traffic to another and collided with our client’s vehicle, causing her injuries in the process.  Ultimately, it is why his insurers had to pay her financial compensation.
