DELIVERY DRIVER INJURED BY UNSAFE LOAD IN STORE DELIVERY

Our client was a HGV driver making a Delivery to a large store and was asked to park on a slight incline and unload.  He was struck by a heavily laden roll cage, which came towards him as he attempted to unload on the slope.  This had not been secured properly in the back of his lorry by the defendant’s employees.  As a result, the heavy cage struck our client on his left side and he sustained Injury to his shoulder.  This caused him severe pain for some time following the incident and he also required physiotherapy treatment.  We were able to recover Personal Injury compensation for our client of £4,650.

A brief summary of events is set out below.

Date of Accident:  August 2013

Time between formal instruction and successful conclusion:  We were instructed by our client in March 2014 and settled the case just six months later in September 2014.

How the claim proceeded:  This was a fairly straightforward case, with the defendant’s Solicitors admitting liability, after we had instructed a medical consultant to prepare a report, setting out the details of our client’s injuries.  We then prepared a report of our client’s financial losses, which were also submitted.

Were Court proceedings necessary?:  No, as liability was admitted straight away and we were able to reach a settlement promptly.

Outcome:   The client secured £4,500 for his injuries and £150 for his financial losses, including care and assistance required for up to three months following the accident.

Comment:  In this case, the defendant’s employees who loaded the lorry trailer failed to do so properly, as they did not use safety straps for some of the roll cages.  The unloading area was also on a slight slope, which contributed to the unsecured cages moving.  These factors clearly breached the Workplace (Health, Safety and Welfare) Regulations 1992
