CAR DRIVER INJURED BY ONCOMING VEHICLE RECEIVES FINANCIAL COMPENSATION

Our client was a car driver proceeding along an A road after dark, when a delivery driver travelling in the opposite direction suddenly turned right across his path.  He had no time to brake and avoid a collision, resulting in the other vehicle striking the front offside of his car.  He sustained injuries to his neck and shoulder, which required physiotherapy treatment, and suffered with symptoms from his injuries for several weeks following the accident.  We were able to recover Personal Injury compensation for him of £1,895.

A brief summary of events is set out below.

Date of Accident:  December 2013

Time between formal instruction and successful conclusion: We took on the case in July 2015 and settled it just 12 months later.

How the claim proceeded: It was almost 18 months following the accident before our client contacted us.  Whilst he had begun to recover from his injuries, he was still suffering with neck pain and stiffness to his right shoulder, despite undergoing a course of physiotherapy treatment.  The opponent’s insurers had previously admitted liability for the accident, so when we contacted them with our client’s personal injury claim they did not dispute liability.  It was necessary for us to determine his exact injuries and ongoing symptoms, so arranged for him to see a court approved medical expert in General Practice medicine.  Whilst the expert’s report was able to detail his overall injuries, it recommended he be referred to an Orthopaedic Consultant to give a more detailed prognosis of his neck and shoulder injuries.  By June 2016, we were in receipt of the Orthopaedic specialist’s report and this concluded that the stiffness our client was suffering from in his shoulder area was unlikely to get any better.  Having all of the necessary medical evidence we needed and a breakdown of our client’s financial losses, we were able to value his claim and put forward a settlement proposal to the insurers.  Despite rejecting it, the insurers did respond with a counter offer, slightly lower than our original valuation, which our client was happy to accept.

Were Court proceedings necessary?: No.

Outcome:   The client secured £1,750 for his injuries and £145 for his financial losses, including the cost of the physiotherapy treatment he required.

Comment:  The delivery driver who was travelling in the opposite direction was clearly driving in an unsafe manner by turning across the path of our client’s car.  Fortunately, although the injuries he suffered took time to recover from and he was left with a degree of permanent stiffness in his shoulder, they were not life threatening.  If the delivery driver had displayed more care and attention whilst on the road, this accident would never have happened.
