FRONT SEAT PASSENGER INVOLVED IN VEHICLE COLLISION RECEIVES COMPENSATION FOR INJURIES

Our client was a teenager who was travelling as a front seat passenger in a car with her father, when another vehicle suddenly turned right across their path causing a collision.  She sustained injury to her chest from the seatbelt she had been wearing, which caused pain and discomfort and suffered neck pain and stiffness and bruising to her right shin.  She suffered symptoms from her injuries for 1 month following the accident and we were able to recover Personal Injury Compensation for her of £1,200.

A brief summary of events is set out below.

Date of Accident:  December 2013

Time between formal instruction and successful conclusion:  We took on the case in July 2015 and settled it 18 months later.

How the claim proceeded:  It was 18 months after the accident when our client’s father, who had been driving the vehicle at the time, contacted us.  Our client was still under the age of 18 at that point, so he initially acted for her.  Having written to the insurers detailing our client’s claim for compensation, we awaited their response and less than 3 weeks later they admitted full liability for the accident.

To get a full picture of the injuries our client had suffered during the accident, we arranged for her to see a General Practitioner.  He was able to prepare a report detailing her injuries and giving his opinion and prognosis for her recovery, which could be disclosed if court proceedings became necessary at a later date.

When we received the medical expert’s report he commented that our client had made a good recovery from all of the injuries she suffered in the accident and he did not believe that there would be any recurrences or later complications as a result of any of the injuries.

By late 2016 we were able to fully value our client’s claim for compensation and with our client turning 18, her father no longer had to act for her.  Having completed our contractual documents, we received her authority to put forward a settlement proposal to the insurers.  After just a few weeks of negotiations our client accepted £1,200 compensation.

Were Court proceedings necessary?: No.

Outcome:   The client secured £1,200 in total compensation.

Comment:  The car our client was travelling in was proceeding correctly, having just passed through a green traffic light, when the oncoming vehicle turned across their path, leaving them unable to avoid a collision.  It transpired that the other vehicle was being driven by a delivery driver who was not demonstrating due care and attention whilst travelling on the road.  Whilst the vehicle our client was travelling in was written off, fortunately the injuries she sustained were not severe and she was able to make a complete recovery.
