Our client was a HGV driver who was collecting pallets from a business premises.  Once his lorry had been loaded he began to secure the curtain sides of his trailer and as he was doing so, he was struck from behind by a Fork Lift Truck which was loaded with pallets.  He was hit by the pallets and sustained injuries to his neck, back and right shoulder, causing prolonged symptoms for almost a year following his accident and requiring physiotherapy treatment to aid his recovery.  We were able to recover personal injury compensation for him of £3,750.

A brief summary of events is set out below.

Date of Accident:  October 2015

Time between formal instruction and successful conclusion:  We took on the case in January 2016 and settled it in September of that year.

In June 2016, we were contacted again by the insurers, wanting to clarify when we would be in receipt of medical evidence to substantiate our client’s accident related injuries.  It was a further 2 months before we received the comprehensive written report from the A & E Consultant, whose opinion was that the ongoing symptoms our client was suffering in his back should settle within 12 months of his accident with the benefit of physiotherapy treatment.

Having compiled a schedule of our client’s financial losses since his accident, we could then value his claim for compensation.  In late August 2016, we were able to contact the insurers with a settlement proposal and just over 3 weeks later they made a counter offer very close to our original valuation, which our client was happy to accept.

Were Court proceedings necessary?:  No.

Outcome:   The client secured £3,500 for his injuries and £250 for his financial losses, including the cost of rehabilitation treatment required following his accident to aid his recovery.

Comment:  Despite having pallets on the forks, the employee was driving the fork lift truck forwards and could not see where he was going.  As a result of our client’s accident, the company responsible subsequently introduced a new safe systems of working to ensure that such accidents could not happen again, but had they adopted these sooner our client would not have suffered injuries which left him with a prolonged recovery period.
