Why EC allotted Samajwadi Party and 'Cycle' to Akhilesh Yadav?

Declaring its verdict the Election Commission gave the 'Cycle' symbol to the faction led by Akhilesh Yadav on Monday. The verdict came as a major boost to the CM Akhilesh Yadav ahead of assembly polls in the Uttar Pradesh.


As the EC draws curtains to the long ongoing fight in the Samajwadi Party over the 'Cycle' symbol where Akhilesh Yadav trumped his father Mulayam Singh Yadav.

Below is the analysis of how Akhilesh Yadav won the Cycle.

The election commission mainly considered for two issues for their verdict.
1. Whether the commission satisfied that is there a split in the Samajwadi Party, resulting in the formation of rival section for groups in the party: one led by Akhilesh Yadav and the other led by Mulayam Singh Yadav.

2. If there is a split, which of the two sections or groups is the real Samajwadi Party. The Election Commission relied on Sadiq Ali vs Election Commission of India case of 1972 pertaining to the Congress Party's Split.

Election Commission of India decided that the matter of Samajwadi Party fall under the para 15 of the Symbols order, 1968. Akhilesh Yadav's lawyer Kapil Sibal had mentioned that the SP has splitted and there is two groups - one is led by Akhilesh Yadav and the another by Mulayam Singh Yadav. The Election Commission satisfied that there is two groups of Samajwadi Party -- one is led by Akhilesh and Ram Gopal Yadav and the another by Mulayam.

Akhilesh Yadav has shown an overwhelming majority by both the legislative and organisational level in the party. He had submitted affidavit of party MLAs, MLCs, MPs and other national executive members of the party.

According to the party's constitution, National Executive meeting is required, at least once in two months, to be called by the president of the party. However, no any National Executive meeting was held since 25th June, 2014, that is a significant violation of the party's constitution.

The main contention of Mulayam Camp was that the expulsion of Ram Gopal Yadav and he was not even a member of the party when he called the national convention of the party. But Election Commission noticed that section 30 of Samajwadi Party constitution enlists that in case of indiscipline, a 3-member committee has to be constituted to consider that. However, no any procedure was followed in the expulsion.

While Election Commission had asked both the factions to submit the letters of support to back their claim, Mulayam Singh Yadav did not provide any affidavits of the party MLA/MLC/MP/Delegates in his support.

A great happiness for Akhilesh camp 
The ECI order bring great happiness in the Akhilesh Yadav's camp with the supporters marching towards his residence and breaking into the celebrations, bursting the fire crackers and dancing to beat of drums.

The Samajwadi Party Secretary Ram Gopal Yadav, Akhilesh' uncle, who was a main strategist of his group, expressed the hope that a grand secular alliance will be formed to contest the assembly elections, a clear reference to a tie-up with Congress and the some other parties.

Akhilesh Yadav went to meet his father Mulayam Singh Yadav, as soon as got the news, to seek his blessings. 

Later in the evening, he tweeted that "Cycle chalti jayegi, aage badhti jayegi..."
