1985 Memo a problem for Alito?

Reports have been coming out of Washington lately that has not looked extremely well for President Bush and his recent nominee Samuel Alito. Democratic senators and abortion rights groups have immediately latched on to a recently released memo from the Reagan administration. When applying for a promotion in the conservative administration Alito wrote that "the Constitution does not protect a right to an abortion" on the application for promotion.

Since its release Democratic senators have called this just another reason why Alito is an ultra-conservative who should not be on the bench. Harry Reid immediately responded with these scathing polemic,
"a picture of Sam Alito is emerging that may explain why the right wing is popping champagne corks. We don't have to guess whether Judge Alito's description of himself in that memo would predict what kind of judge he would be. For the past 15 years, Judge Alito has been one of the most conservative federal judges in the country."

However Republican senators have not sat idly while this has occurred. In a recent editorial in the Chicago Tribune Senate Majority leader Bill Frist threatened Democrats with the nuclear option once again. Frist promised that if Democratic senators attempted to filibuster Alito they would leave him with "no choice" but to eliminate the filibuster. That leaves the question, where does the group of 12 stand on Alito? Does he fill the extreme requirement or not? We have yet to hear from all of them but hopefully a picture will emerge in the coming days.
