TX Judge Rules Against Abortion Law


A Texas State District Judge ruled that the unique Enforcement Scheme of a Restrictive Abortion Law Violated the State Constition by Allowing any Private Citizen to Sue Abortion Providers or Others accused of Breaking the Law.

In a 48 page Opinion, Judge David Peeples found that the appoach, which has been seen by Anti-Abortion Groups as its greatest strength, Unconstitutionally granted Standing to those who were Not injured, Denied Due Process and Represented an unlawful delegation of enforcement power to a private person.

While the Ruling was deemed an Important Victory for Abortion Rights Group, Abortion Providers said that they would Not immediately Resume performing thr Procedure after about Siz weeks of Pregnancy.

The Decision was brought aginst Texas Right to Life, an Anti-Abortion Group, who immediately filed a Notice of Appeal.

I think, since Roe v. Wade is still Law, Texas Judges would Throw Out these Cases, claiming No-Standing, as the Texas Law Senate Bill 8, the Heartbeat Law, was Unconstitutional, so there is No Case.
