A Federal Judge Declined, Thursday, to Dismiss a Lawsuit brought by Environmental Groups against the Tennessee Valley Authority (TVA).

The Environmental Groups, including Memphis-based Protect Our Aquifer, had argued the Auto-Renewing, 20-year Contracts, TVA has offered Local Power Companies, in its footprint, Violate the TVA Act, the Federal Law that Governs the Federal Government-Owned Utility.

The Length of those Contracts, the Groups argued, would allow TVA to Drag its feet on Moving away from Carbon-based Sources of Energy and Stymy its potential Efforts to Reduce Carbon Emissions.

U.S. District Judge, Thomas Parker, sees enough Merit in the Environmental Groups' Claims that he is letting the Lawsuit proceed.

All Three Plaintiffs allege that the Long-Term Agreements, inhibits their Ability to Advocate because it, Insulates TVA from Competition, making TVA and Local Distributors, Less willing to engage in Meaningful Conversation.

TVA argued that the Long-Term Power Agreements does Not Govern its Power Supply choices, but other, different Planning Documents, are an Argument, that Parker appears to have seen some Merit in.

The Court recognizes that TVA puts forth compelling arguments that may prevail in the End. But this is a Motion to Dismiss, and Plaintiffs’ burden to show Standing will increase at each successive stage of litigation, Parker wrote.

Parker's Ruling means the Case will Proceed and could potentially impact Memphis' Future Power Supply Decision.

Memphis, Light, Gas, and Water, has asked the Private Sector for Bids on its Power Supply and the Bidding Opened in Recent weeks.

The City of Memphis-owned-Utility, could also Sign the 20-year Deal TVA has Offered Memphis, like its other Local Power Companies.
