Judge Blocks Trump Administration Asylum Rules


A Judge Blocked a set of Trump Administration Asylum Rules from going into effect.

U.S. District Judge, James Donato, in San Francisco on Friday, ruled Against the Administration, saying that Acting Homeland Security Secretary, Chad Wolf, Lacked the Authority to Implement the December Measures because he has never been Confirmed to his Position by the Senate.

The Judge said it was the Fifth Time a Court has Ruled against the Department for the same reason. "The government has recycled exactly the same legal and factual claims made in the prior cases, as if they had not been soundly rejected in well-reasoned opinions by several courts," Donato wrote. "This is a troubling litigation strategy. In effect, the government keeps crashing the same car into a gate, hoping that someday it might break through."

The Rules would have made it more Difficult for Asylum to be Granted to a Person who has been in the United States Unlawfully for more than a year or has Failed to Pay Taxes.

Those Seeking Asylum on the Basis of Gender or those who Claimed to be Targeted by Gangs, "rogue" Government Officials, or "non-state organizations" likely would have been Ineligible.

"Death to asylum is not an exaggeration," Niels Frenzen, an Immigration Law Professor at the University of Southern California, said, adding that the Scope of the Rule “would bar many, perhaps most claims from Central America, which is the intent."

As a Result of the Coronavirus Pandemic, most Asylum-Seekers to the U.S. have been Turned Away.
