Appeals Court Blocks Trump Administration Effort to Weaken Protections for Asylum Seekers


The Case was brought by 12 Asylum Seekers, Represented by the American Civil Liberties Union and the Center for Gender & Refugee Studies (CGRS), who argued the Administration's Policies would Raise the Standards for Asylum far beyond Congress' Intentions.

A Federal Appeals Court dealt a New Blow Friday, July 17th, to Trump Administration Policies that would Remove Protections for Asylum Seekers from Deportation.

The D.C. Circuit Court of Appeals Upheld Provisions in a Lower Court's Ruling that Blocked the Trump Administration from Implementing Policies that would have Effectively Barred Women fleeing Domestic Abuse and Gang Violence from seeking Asylum in the U.S.

“The court rejected the Trump administration’s attempt to obliterate asylum protections. This ruling is a major defeat for the administration’s assault on asylum rights and the law," Cody Wofsy, an ACLU Lawyer who Argued in the Case, said in a Statement.

The Administration attempted to Dramatically Scale Back Asylum Protections in the Summer of 2018 for Central American Women who Claimed they were Persecuted by Abusive Spouses and Gangs. Then Attorney General, Jeff Sessions, Argued that Spousal Abuse and Gang Violence did Not Qualify an Immigrant for Asylum Status, and the Department of Homeland Security (DHS) Issued a Memo paving the way for the Women's Removal.

The U.S. District Court in Washington Blocked the Administration's attempts in December 2018, largely Agreeing with the Asylum-Seekers that the Department's Policy would Unreasonably Elevate the Standards for establishing a "credible fear" that would put the Women in line for Asylum.

The Appeals Court's Three-Judge Panel backed Key Aspects of the District Court Ruling, 2-1.

Judge David Tatel, a Clinton Appointee, and Judge Thomas Griffith, a George W. Bush Appointee, joined in the Decision, while Judge Karen Henderson, a George H.W. Bush Appointee, Dissented.

"This ruling recognizes that women and others fleeing domestic violence and gang brutality cannot be cast aside as undeserving and must have their claims considered fairly, on a case-by-case basis,” said CGRS Legal Director, Blaine Bookey, in a Statement.

We now wait for an the Administration ask for a Full Court (En Banc), Decision.
