Congressional Term Limits Convention Update


Article V - America’s Visionary Founders planned for and Equipped our Constitution with the Article V Convention, which allows the American People to Term Limit Congress without needing Congressional Approval. This process, which comes not from Washington but the States, was designed specifically to rein in Abuses of Power coming from Members of the House and Senate.

How it works:

1. Two-thirds of State Legislatures (34) must Pass Bills applying for a Convention to consider Only Amendments for Congressional Term Limits.

2. Congress is Compelled by Law to Call the Convention, which includes Delegates chosen solely by their Respective States.

3. If the Convention Reports out an Amendment for Congressional Term Limits.

4. Then the Amendment must be Ratified by either Three-Quarters (38) of State Legislatures or State Conventions.

As of December 13th, 2018, the Number of States with Legislative Term Limits is 15. They are: Arizona, Arkansas, California, Colorado, Florida, Louisiana, Maine, Michigan, Missouri, Montana, Nebraska, Nevada, Ohio, Oklahoma, and South Dakota.

Twenty-Three States: AK, AR, AZ, CA, CO, FL, ID, ME, MA, MI, MO, MT, NE, NH, NV, ND, OH, OK, OR, SD, UT, WA, and WY, Passed Federal Congressional Term Limits at the State Level before the 5-4 U.S. Supreme Court Decision in U.S. Term Limits v. Thornton declared the Requirement of a Constitutional Amendment to Limit the Terms of Congress. These Statutes are still on the State Books, however, they are Not Enforceable unless the Supreme Court Decision is Overturned.
