The Equal Protection Challenge to Winner Take All


Lester Lawrence "Larry" Lessig III is an American Academic, Attorney, and Political Activist. He is the Roy L. Furman Professor of Law at Harvard Law School and the Former Director of the Edmond J. Safra Center for Ethics at Harvard University. Lessig was a Candidate for the Democratic Party's Nomination for President of the United States in the 2016 U.S. Presidential Election, but Withdrew before the Primaries.

Today, the Non-Profit he founded, EqualCitizens.US, announced it would Crowdfund Support for Two Lawsuits to Challenge the way Votes are Allocated in the Electoral College.

All but Two States Allocate their Vote according to a Winner-take-All System, in which the Winner of the Popular Vote gets All the States Electoral Votes.

He believe Winner-Take-All Violates the Equal Protection Clause of the 14th Amendment, and he intends, through EqualVotes.US, to build a Case and a Campaign to get the Supreme Court to agree.

He's not the first to have this thought. Sam Issacharoff’s an Essay about this method to Allocate Votes in the Electoral College. Last November, Professor Rick Hansen published a related Argument on Medium by Jerry Sims.

And He's not so naïve to believe that this Fight will be Easy.

But there is real value in Raising and Pressing this Argument now, with the National Popular Vote Interstate Compact in Full Swing, to have enough States' Legislatures to Vote their Electoral Votes to the Winner of the Popular Vote. Currently you need 270 Votes to win and the Compact has 165.
