The Uttar Pradesh State Law Commission has prepared a legal draft to prevent the leaking of quizzes related to academic and competitive exams and to curb the gang of paper solvers.

The State Law Commission has handed over this draft to the Uttar Pradesh Law Department.

There is a provision of 14 years in jail and a fine of up to Rs 25 lakh in this proposed law.

The State Law Commission in its report related to this legal draft wrote: “Copying has become big business, exams must be canceled due to paper leakage, government money is lost, current law fails to stop the copy”. days or a month, cheating-related headlines appear on the front page of the newspaper. These raise doubts about the credibility of these reviews and tarnish the image of the Uttar Pradesh government.”

There are already two laws against copying in Uttar Pradesh.

Uttar Pradesh Public Inspection (Prevention of Unfair Media) Act 1992 and Uttar Pradesh Public Inspection (Prevention of Unfair Media) Act 1998.

Considering the young age of the minors examined in these laws, there were only provisions for token punishment.

Then the question arises that despite the existing law, why do you feel the need for a new law to copy?

The Law Commission report says: “The incidence of copying has increased enormously and is embarrassing the government. And these existing laws are proving ineffective in dealing with the threat of fixer gangs, paper leaks and copying.”

This is the reason why the State Law Commission, taking its notice, drew up a project to deal with it and sent it to the State Government to make a law.

Shall we tell you what provisions have been maintained in the bill to stop copying in the UP and what has been the history of copying in the UP?

Copy Methods and Provisions of the Bill

In this regard, the report of the Legal Commission says that there is an organized system of copying and copying in the state. This is done by paper leak, via Bluetooth, through groups of paper solvers, and may also include employees and officials of the department and companies conducting the exam.

Whenever STF of Uttar Pradesh or any other investigative agency stopped the gang of copycats caught If so, the same methods of copying and performing have been expounded over and over again with some difference.

The name of the proposed draft cheating law is the Uttar Pradesh Public Examinations Bill (Prevention of Unfair Media, Paper Leaks and Solver Gang Activities), 2023.

To convert it into law, the government must approve it in both Houses of the state and declare it as law through the gazette. If necessary, the government can also pass your ordinance.

In this draft, the “Solver Gang” and its methods have been defined in great detail. Anyone who helps copy in any way is considered a member of the solver gang.

There is a provision for the use of modern technology in copying and the punishment of people who execute it (copy).

Students found guilty of cheating will have their results withheld or the candidate will be prohibited from taking the next two exam sessions.

Anyone found guilty of running a fixer gang can be jailed for 5-14 years and may have to pay a fine of 25 lakhs.

There is also a provision for seizure of property in this proposed law.

The draft reads: “The district DM has full authority to seize property purchased with money earned from the copy business.”

In this law, the company that prints the exam can be charged a fine for canceling the exam or compensating the government for the financial loss caused by copying, and a lifetime ban can be imposed on the company.

But if the Law Commission is to be believed, the copying problem in the state is still highly organized and widespread.

The need for a new law arose from a poll by the Law Commission, in which more than 61 percent of people were in favor of a stricter law to stop plagiarism.

In this survey, the Law Commission sought responses from judicial officials, universities, district courts, superior court officials, state government officials, and laypeople on an 18-question questionnaire.

In this, people were specially asked the question of enacting a strict law against copying.

Along with this, questions were also asked about the role of the solver gang, the paper leak, educational institutions, parents of students, and the role of exam-taking institutions.

It was revealed in the survey that more than 67 percent of people believe that unemployment is rising in the country due to copying incidents and paper leaks. At the same time, 95 per cent of people believe that this is hampering the productivity of Uttar Pradesh.

81 per cent of those surveyed believe that poor practice in health services, inefficient engineers and fraud in banking facilities create social ills due to bad exam practice.

The Law Commission says it got enough responses in the survey to make the bill.

Andhra Pradesh In this, there is a provision of imprisonment of 3 to 7 years and a fine for those guilty of using “unfair methods” in the exam.

rajasthan In this, there is a provision for a sentence of three years in prison and a fine for the person who leaks the paper.

Jammu and Kashmir In this, there is a provision for the maximum punishment of 2 years and a maximum fine of two lakhs for the use of “unfair methods” in the examination.

chattisgarh There is a provision of one year in prison for paper leakers. But if there is a heinous crime related to copying, then the punishment can be up to 5 years.
