Pawan Khera: Released after seven hours of rampage: CJI gave advice, relief from arrest until February 28

The Supreme Court gave great relief to the senior leader of the Congress, Pawan Khera, arrested by the Assam police. The high court on Thursday ordered the Delhi court to grant interim bail to Congress leader Pawan Khera. A three-judge Supreme Court bench headed by Chief Justice DY Chandrachud said “Kheda will be released on interim bail after being brought before the competent magistrate in Delhi.”

Apart from relieving Pawan Khera from arrest, CJI DY Chandrachud also gave some great advice. After the hearing in Pawan Kheda’s case ended, his lawyer Abhishek Manusinghvi said in a conversation with the media: ‘Assam police did not arrest in this according to the established rules. The Supreme Court on Thursday ordered Congress leader Pawan Kheda to be released on provisional bail by February 28. A bench of Justice Chandrachud, Justice MR Shah and Justice PS Narasimha said: “The above order will take effect until Tuesday (Feb 28).”

The court has set February 27 as the date for the next hearing on the matter. Along with this, notices have been issued to the states of Assam and Uttar Pradesh, seeking their response to Kheda’s petition, in which it has been requested to gather various FIRs filed against him in both states regarding his alleged comments against the Prime Minister. Earlier, while arguing in court on Kheda’s behalf, top lawyer Abhishek Manusinghvi said that “the Congress leader apologized for his comments about the prime minister on the same day and there is no need to arrest him in connection with the charges leveled against a he.” He said the choice of words used in the comment and the imposed sections do not match the alleged offenses. Earlier on Thursday, Pawan Kheda, head of the party’s media department, who was en route to Raipur to take part in the national Congress convention, was dropped from the Raipur-bound plane. On February 17, Khera was arrested at the Delhi airport in connection with his alleged comments against Modi at a press conference in Mumbai.

Meanwhile, the Delhi police said that Pawan Khera was detained at the request of the Assam police. Faced with such a situation, the congressional leaders accompanying him sat in a dharna on the airport runway in protest and opposed attempts to take him away without a warrant.

Later, senior officers of the Delhi Police handed him a document from the Assam Police, requesting his help in arresting Pawan Khera. Congress leader Randeep Surjewala then accompanied Khera to a police station at the airport where the Central Industrial Security Force (CISF) was heavily deployed.
