Having outstanding Debt is not something that most people set out to be a part of their liability. However, sometimes things happen, jobs get lost, income streams slow down, or other factors prevent someone from paying off their debts. In these cases, it is possible for a debt collector to be called in, in the hopes of recovering the money a lender is losing. Fortunately for people, there are Texas debt collection laws’ that protect both the lender and the borrower.

Texas law allows for the collection of debt. What it doesn’t allow for is harassment in the hopes of coercing for the payment. A debt collector may not badger, stalk, or belittle a debtor. They cannot garnish a debtor’s wages or threaten to take the home and unless they actually do intend to sue you, they cannot spout empty threats. Unfortunately for you, it is legal for debt collectors to call you, call your family and friends, and to call your place of employment to gain information about your address, phone number, or location. To get a debt collector to stop calling you, simply write them a letter telling them to stop. According to Texas debt collection laws, they have to stop calling you.

If you don’t believe that you owe the debt, there is something you can do. Speak to the debt collector, get their address, send a letter stating why you don’t owe the debt and send any proof you may have. Once they receive the letter they must stop contacting you. However, they may resume attempts to collect the debt if they have proof that you do owe the debt. It is best to calmly and professionally speak to the debt collector. Ask them to stop calling you, send them a letter asking them to stop calling you, and show them proof that you do not owe the debt.

It is a bad day when debt is owed to a creditor. It is even worse when debt collectors begin calling and harassing debtors. The best idea is to pay any debt that you owe. If that isn’t possible, Texas debt collection laws are in place to protect you.
