The Overriding Objective is set out at the start of the Family Procedure Rules, and sets out a blueprint for how judges should manage cases. This includes the following consideration:
Judges should give each case an appropriate share of the court’s resources, while taking into account the need to allot resources to other cases.
What this means is that a judge will not simply make themselves available to decide any dispute between you. The Family Court is a public resource funded by the taxpayer. Your case will be given the amount of time a judge thinks it merits, whether you think it deserves more consideration or not. Increasingly, judges are urging families to resolve their differences out of court, and some will adjourn cases to require you to make efforts to settle through alternative means, including joint legal advice and mediation.
