Choosing the Right Mediator for Your Separation

When you’re going through a separation, having the right Mediator can make all the difference in the experience you have and how conflict is resolved between you and your soon-to-be former spouse. Not every mediator will be the right one for you, but there are a few things you can do to help you choose the right one.

Examine their background

When looking for a mediator for your separation, you want to find a mediator with experience in family law. It might seem like an obvious thing to look for, but take a look at their credentials before selecting them. It’s ok to ask questions and learn more about the mediator before agreeing to work with them.

Get a referral

It may seem like an odd thing to ask friends or family whom they used for their divorce, but word of mouth is very important in family law. Hearing about someone’s personal experience, may help you anticipate what your experience might be like.. Getting a referral for a mediator can also be a great starting point.

Fair Costs

Many people believe getting divorced is a very costly process, and in some cases, it can be. Seek details from the mediator about their fees.

Dedication

You will want to make sure the mediator you have is dedicated to your case. It is important to seek out if the mediator has sufficient capacity to ensure that your matter is given adequate attention. .

Impartiality

During mediation, you want to make sure that the mediator is not going to take sides – they have to be impartial to both sides and focus on the facts.

Certified Mediators in Ontario

The Ontario Association for Family Mediation is a professional organization within the province of Ontario. The requirements to join this association have become the standard for family mediators across the province. Each member must meet specific requirements, pay membership dues and follow the standards of practice to be part of this association.

When looking for a mediator, working with someone who is part of this association ensures they have met all the strict requirements and they are also upholding the standards of practice.

Your gut feeling

When you first meet with the mediator, you will probably have a good feeling about whether you want to work with them. Can you trust them? Do you feel good about working with them? Don’t discount your instinct when talking to a mediator. Make sure you feel good about the answers they provided you and the feeling they gave when discussing your case. If you feel they are not going to give your case the appropriate amount of attention or dedication you deserve, don’t be afraid to say you want to keep looking at other options.
