Delhi HC refuses to entertain PIL to ban dangerous dog breeds.

Introduction:

The Delhi High Court declines to hear a PIL to outlaw dangerous dog breeds.


A bench presided over by Chief Justice Satish Chandra Sharma instructed the petitioner, Legal Attorneys & Barrister Law Firm, to first bring its complaint before the appropriate government agencies rather than bringing it immediately before the court.

The petition brought attention to numerous instances in which these dog breeds attacked people, including their owners.
up Thursday, the Delhi High Court declined to take up a public interest lawsuit seeking to outlaw and revoke permits for the ownership of “dangerous” dog breeds such pitbulls, terriers, American bulldogs, rottweilers, etc.

A bench presided over by Chief Justice Satish Chandra Sharma instructed the petitioner, Legal Attorneys & Barrister Law Firm, to first bring its complaint before the appropriate government agencies rather than bringing it immediately before the court.

“This PIL trend is incorrect. This is a policy choice, the bench, which also included Justice Sanjeev Narula, declared.

“You make a representation to the government that this is my grievance before filing, but you have come directly to court,” the filing instructions said. The court instructed the petitioner’s attorney that a preliminary representation was required.

The Municipal Corporation of Delhi was still registering species like bulldogs, rottweilers, pitbulls, terriers, Neapolitan Mastiffs, and others to be kept as pets, the petitioner claimed in its PIL, despite the fact that these animals are considered “dangerous dogs” and are prohibited in more than 12 nations, including India.
