Jan 6 Trump Supporter Who Used Hockey Stick on Police Is Sentenced

On Wednesday, a fan of Donald Trump gets sentenced.

Sentenced to More Than 3 Years in Federal Prison

A fan of Donald Trump who accepted the former President’s falsehoods regarding the 2020 election was given a sentence on Wednesday of more than three years in federal prison for using a Hockey Stick to attack law enforcement officials during the violent altercation that took place at the U.S. Capitol’s lower west tunnel on January 6.

Federal Officers Assaulted With Hockey Stick

After being taken into custody in January 2021, Michael Joseph Foy was first placed in pretrial detention. In June, he was convicted guilty of felonies. Prosecutors asked for a sentence of more than eight years in federal prison for Foy, claiming that he attacked police officers with a hockey stick and a metal rod that had been sharpened after carrying a “TRUMP 2020” banner to Washington.

A Sentence of 40 Months

However, U.S. District Court Judge Tanya Chutkan, who is presiding over Trump’s postponed federal trial on allegations that he attempted to oust his defeat in the 2020 election by collaborating to obstruct Congress and deny American citizens their right to vote, declared on Wednesday that the Justice Department’s request was “unreasonable” and failed to take into account Foy’s previous military service and other circumstances in his life before January 6. In the end, Chutkan decided to sentence Foy to 40 months, which meant he would spend an extra two years and a few months in federal prison.

Foy’s Family Also Bought Into Trump’s Lies

The FBI claims that Foy visited the TCF Center in Detroit following the 2020 election, when Trump supporters assaulted poll workers, pounded on windows, and made up stories about the voting process in an attempt to prevent absentee ballots from being tabulated. Foy’s attorney stated in court on Wednesday that Foy was especially vulnerable to the false information being disseminated by Trump and his associates since his mother and stepfather were “ardent Trump supporters” who also believed Trump’s claims regarding the election.

The Defense’s Argument

One of Foy’s federal public defenders, Elizabeth Mullin, contended that a long sentence would not deter future rioters from reacting to fabricated allegations and inflammatory language from political candidates. She contended that a punishment for a lone Jan. 6 rioter wouldn’t be all that deterrent when well-known individuals, such as the presumed Republican presidential contender, are spreading false information regarding the 2020 election. Before the trial she would preside over, Chutkan avoided being drawn into a debate about the former President’s guilt for the attack on the Capitol.

I’m Not Getting Into That

Chutkan grinned and added, “I’m not getting into that,” which caused the courtroom to erupt in laughter. When the defense lawyer brought up the issue of Congressmen who had acted on Trump’s election falsehoods and were now promoting them, she responded, “Also not getting into that.” The idea that Foy had just intended to use the hockey stick he brought from Michigan as a flagpole infuriated Chutkan.

This Isn’t a Hockey Town

Chutkan remarked, “This isn’t a hockey town,” implying that Caps supporters “may disagree.” In the end, Foy used the hockey stick as a weapon in the Capitol, according to Foy’s lawyer.

Foy Describes Himself as a “30-Year-Old Loser”

A video that was shown before Foy’s sentencing showed him calling himself a “30-year-old loser” who had been living at his mother’s house prior to the attack, when he had fallen for what his lawyer called the “dire propaganda” of the former President. After his initial arrest, Foy praised Chutkan for assisting him in receiving “much-needed mental health help.” During the hearing, Chutkan was informed by Foy, “Not a day goes by where I didn’t say to myself, ‘I’m not going to let you down.'”

I’m Punishing You for What You Did

Chutkan stated that Foy was free to demonstrate in a nonviolent manner and that he was still free to accept any falsehoods he wanted to concerning the 2020 election. However, she expressed her optimism that Foy had now realized he had “embraced” incorrect notions “based on misinformation.” She repeated that Foy was not being penalized for his misbeliefs. She said to him, “I’m punishing you for what you did.”

There Have to Be Significant Consequences

Chutkan described the events on January 6 as “terrifying,” saying she was “horrified every single time” she saw the footage from that day. According to her, deterrence “is a very important factor” in preventing future rioters from acting upon any fraudulent statements made by political candidates. Before January 6, Chutkan remarked, “I’ve seen so many people who never lifted a hand in violence…There have to be significant consequences.”
