RTA Claims Dispute over Lawyer Costs

In a recent RTA claims battle, the Law Society lay a dispute claim against Haven insurers. This dispute was about unpaid legal costs on the part of Haven Insurers. The result of the dispute claim at the Court of Appeal was that the Law Society won £12, 500 in costs for Gavin Edmondson Solicitors.

The RTA dispute concerns six individuals and their RTA claims. Local value RTA claims were the subject of the dispute claim. Haven chose not to pay pre-action protocol solicitor costs. The Haven Insurance Company agreed to settle these individuals’ RTA claims directly.

Taking the RTA disputes to the Supreme Court

Beyond RTA dispute claims, it is important to agree on the general matter of insurance companies settling claims directly. This is why the Law Society took the matter to the Supreme Court. The Law Society raised an important question: how much can the court intervene regarding the protection of lawyers’ fees? The verdict on this case could result in many other law firms claiming against insurers in respect of their solicitor costs.

Fixed fees and stage one costs from insurers are a lawyer’s right as a result of the 'tripartite’ agreement between the solicitor, the lawyer and the client. Thus, the Law Society said that the ‘principle of equitable interference’ needed to be instated. This would mean that solicitors could ensure that they then received these costs.

Claims Laws and the Supreme Court

RTA disputes were just one of the controversial issues around personal injury claims that concerned the Supreme Court this year. The Telegraph reported that there was an increase in fraudulent personal injury claims. This was blamed on no win no fee lawyer services as well as “cold callers encouraging people to sue.” The Supreme Court Judge advised that blame should be taken out of personal injury. This was because the proposed changes to the law have not yet gone far enough.
