Food License (FSSAI) - Types, Registration, Documents & Late fee

According to Food Safety and Standards Authority of India (FSSAI), every Food Business Operator (FBO) must be Licensed / Registered. In simple words, if you are dealing with any food items, you must have FSSAI License or Registration.

Also remember, now the whole process of FSSAI Licensing or Registration is done online and you need not to visit any FSSAI office physically.





Who need to obtain FSSAI License ?

Every Food Business Operator (FBO) who are Manufacturer/ Processor/ Re-packer/ Re-labeler/ Importer/ Storage distributor/ Seller of any food product, must obtain FSSAI License/ Registration.

Types of FSSAI License/ Registration ?

Registration
Small Food Business Operators whose annual gross turnover is below 12 lakh, don't need FSSAI License, but they need FSSAI Registration.

State License
Generally, Medium Food Business Operators whose annual gross turnover is more than 12 lakh, but less than 20 Cr (in some cases 30 Cr. such as wholesaler, Transporter etc. or in some cases it depends on Capacity) need State License.

Note:
In case Food Business activity is carried out, located in more than 1 state with the same name of the company or organisation, FBO has to obtain one additional Central License for Head Office/ Registered Office and separate license for each location as per Capacity/ Turnover (State/ Central License)

For how many years FSSAI License / Certificate can be applied or renewed ?

You may apply for New FSSAI License / Certificate or Renew existing FSSAI license / Certificate for 1-5 years.

Can Manual License No. be renewed online ?

Manual License no. cannot be renewed online. If you have FSSAI License in manual mode, then before one month of its expiry you need to apply for new FSSAI license online. Your old license number will be changed when you apply online for the first time. Remember, manual license no. cannot be renewed online. Once you get license no. in online, you may renew that no. next time.


 Which documents are required to apply for new FSSAI License / Registration ?

Registration Certificate
1) Form A (Generated after submission of all documents)
2) Photo of Food Business Operator
3) Identity Proof (Aadhaar Card/ Voter card/ PAN card etc.)
4) Trade License.

State License
Mandatory for all
1) Form B (Generated after submission of all documents)
2) Identity Proof (Aadhaar Card/ Voter card/ PAN card etc.)
3) Trade License.
4) Proof of Possession of premises (Sale deed/ Rent agreement/ Electricity bill etc.)
5) Food Safety Management System Plan or Certificate (FSMS) (to be given on the letterhead of FBO/ Firm / Company) Click here to download FSMS form
6) Partnership deed/ Affidavit of Proprietorship / Memorandum and Articles of Association towards the constitution of the firm - for MOA - Three pages need to be uploaded (First page- Certification of incorporation, Second page- Authorization of food business activity and Third page- list of directors with addresses) Click here to download Self-declaration for Affidavit of Proprietorship

Mandatory for Manufacturing and Processing unit
1) Blueprint / Layout plan of processing unit showing the dimensions in metres/square metres and operation-wise area allocation.
2) Name & List of Equipments and Machinery along with the number, installed capacity and horse power used.
3) List of Food category desired to be manufactured. (in case of Manufacturers).
4) List of Directors/ Partners/ Proprietor/ Executive Members of Society/ Trust with full address and contact details. (Mandatory for Companies only)
5) Authority letter with name and address of responsible person nominated by the manufacturer along with alternative responsible person indicating the powers vested with them viz assisting the officers in inspections , collection of samples, packing & dispatch)
6) Analysis Report (Chemical & Bacteriological) of water to be used as ingredient in food from a recognized/ public health laboratory to confirm the potable
7) Production unit photograph.

Other Documents
1)Copy of certificate obtained under Coop Act - 1861 / Multi state coop act - 2002 in case of Co operatives
2) Source of Milk or procurement plan for Milk including location of milk collection centres etc. in case of Milk and Milk product processing units.
3) Source of Raw material for meat and meat processing plants.
4) Pesticide residues report of water in case of units manufacturing packaged drinking water, packaged Mineral water and /or carbonated water from a recognized / public health laboratory.
5) Recall plan wherever applicable, with details on whom the product is distributed.
6) Certificate provided by Ministry of Tourism (HRACC) (applicable for Hotels only).
7) For Transporters-supporting documentary proof for turnover or self declaration of number of vehicles.
8) NOC and copy of License from manufacturer (Mandatory for Relabellers and Repackers only)

Central License
Same as State License, along with following documents,
1) Ministry of Commerce Certificate for 100% EOU
2) Supporting documentary proof for turnover
3) NOC/PA document issued by FSSAI (In case of multiple documents, merge them into one document and then upload)
4) IE code document issued by DGFT

Late Fee :

The Application for Renewal of License shall be submitted 30 days before Expiry of License. Otherwise Rs.100/days will be charged upto the date of Expiry.

For instance, If your License expiry date is 05/02/2019, you need to apply for Renewal before 06/01/2019, otherwise Rs. 100/day will be charged upto the date of expiry.


Does anyone need to submit application or documents in FSSAI office physically ?

Application can be made online. All documents can be uploaded electronically. You need not require to visit FSSAI office or submit documents physically.


What will happen if any problem arises regarding uploaded documents ?

If any problem arises after submission of application, Divisional Officer (DO) will send you the application for Editing. You may also got an intimation by email. You need to correct the errors or upload required documents and submit the application.


How many Licenses are required if FBO has many branches in different states?

If FBO is operating more than 1 State, then FBO has to obtain 1 Additional Central License for Head office/ Registered office and separate license for each location as per Capacity/Turnover (State/Central License).

How many Licenses / Registrations are required if Multiple kind of Businesses are running in one premises?

One Premise with multiple kind of businesses is eligible for one License / Registration only.


How many licenses are required for importers?

Importers to take one single Central License as their IE code address.
