Judge of Supreme Court Condemns Personal Injury System.

Lord Sumpton, Supreme Court Judge claims that ‘the system’ is the real culprit. In his report, he states that the personal injury system is the reason behind the increase in compensation claims and not the consumer. This is because the law chooses to place blame on an individual’s accident. He backs up his statement by mentioning that although personal injury claims have increased, accidents have not. This is a clear indication as to where the fault might lie.

In his argument, it is also made clear that in cases where the state or insurers can’t pay the settlement, the cost falls on the public’s shoulders. Lord Sumpton, also points out that it’s unfair that the claims system based on an individual’s fault relies solely on the state to pay the settlement. Lord Sumpton states, “It often misses the target, or hits the wrong target. It makes us no safer while producing undesirable side effects. What is more, it does all of these things at disproportionate cost and with altogether excessive delay.” Proposing a blame-free system that is tax funded or by “compulsory insurance.”
