The Battle for Equality; Homosexuality in the Boy Scouts of America

Through the decades, Boy Scouts of America (BSA) has been a symbol of glory and excellence to the youth community. These years of excellence has been demonstrated since 1910, giving the youth a chance at imperial glory, through God and their country. However, this program has about 4.5 million members and counting, but there is no single “open” homosexual in the program? If we look into a Supreme Court case between the BSA v. Dale (2000), the court ruling in favor of the BSA by 5/4 vote,  signaling in the first amendment with Dale’s expression in the program. However, through that the BSA is a private organization, they have a right of acceptance to whoever seems fit, “On my honor I will do my best to my duty to God and my country and to obey the Scout law; to help other people at all times; To keep myself physically strong, mentally awake and morally straight” (Boy Scouts of America v. Dale 2000). Even knowing that it’s a private organization following by scout law, Dale did not read the oath to heart as the words “morally straight” came into commission. Also, knowing his existence in the program was since he was a cub scout, to scout leader, he was kicked for their learning of his normal-life outside the program.  In opinion to Dale, his treatment was most pushed over the top even knowing the true purpose is to be mentally and morally straight with God and the country. As a human beings, they have broken rules without facing the fullest consequence; he should have stayed in the program. However, they face others, who do not want the acceptance of homosexuals in the BSA; saying that the BSA is the front-line soldiers and if they leave from their stance of morally straight, then, churches and homes will be affected, “Are the United Ways in your area, or your city or county governments, local corporations ganging up with the homosexuals to persecute the Boy Scouts? If so, what are you and your church and your friends and neighbors doing? The Boy Scouts are on the front line now, but if they fall, your organization, your company, your church will be next” (Jasper 2013).  So your communities will be next to fall under the torment of homosexuality, so that their freedom to join private organizations will be flourished and rid of the haters and prejudice issues. If the BSA were to accept homosexuals, would this stop the hate?  A Boy Scout, a person of excellence who helps one who does not know, because after reading articles upon articles; our countries “imperial army” is nothing but haters in uniform. Through the hate since 1910, equality has not been the answer in the Boy Scouts of America, demonstrating unfair leadership, sexual racism, and the use of mixed 1st amendment in the United States of America.
Boy Scouts of America v. Dale (2000) was one of the most recent court cases dealing with the opinion of sexual-behavior racism. This sexual-behavior racism began when in 1989 Dale became an Assistant Scoutmaster, as a couple of months passed; Dale was attending Rutgers University, which coincided with BSA. In the University, Dale became the co-president of the Rutgers University Lesbian/ Gay Alliance in 1990; later that year, Dale’s picture was published along with an article, addressing to homosexual teens, Dale was dismissed from BSA immediately after. Under New Jersey’s Anti-Discrimination laws, Dale used it to his potential by taking legal action towards the BSA and won the case, however, do to the orientations of the organization being a “distinctly private group;” the BSA were exempt to New Jersey’s public accommodation laws. Later on in the case, forcing by the courts on the scouts to accept Dale would be infringement on the organizations freedom association; leading the case to bigger courts, the Supreme Court on April 26, 2000.  With all that collided in the courts, the BSA defined some statements that homosexuals are not allowed, “The Boy Scouts of America has always reflected the expectations that Scouting families have had for the organization. We do not believe that homosexuals provide a role model consistent with these expectations. Accordingly, we do not allow for the registration of avowed homosexuals as members or as leaders of the BSA….” (Boy Scouts of America v. Dale 2000). So there is the proof of anti-acceptance of homosexuals or really anything that does not follow their ideals. Though, the case was intuitive and controversy was pressuring down on the BSA, their use’s was expressed fairly throughout their Scout’s oath and laws- freedom of expressive association of the private organization; resulting in a 5/4 call, meaning that the exclude of homosexuals was fair and still is exercised today.  Though now, more pressure is gaining in the private program and in the communities around the United States. The BSA is defined in California’s 1998 case, ““A Scout is prejudiced” should not be the 13th point of Scout Law” (Hills 2013). Or even that in the significance of the court case, the BSA had significance support from the government due organization help throughout the country.  Meaning that the case was already decided, already saying basically to the homosexual communities that, “hey we won, just give up.” So give a chance and let’s see what the population wants in this private organization; polls have concluded that due to the stress of the BSA:
“Men supported lifting the ban by 49 percent to 39 percent and women by 61 percent to 27 percent, according to the poll, which surveyed 1772 registered voters from January 30 to February 4 and had a 2.3 percentage points margin of error […] youth membership in the organization, which prides itself on teaching boys life skills such as camping and leadership, has declined 21 percent to less than 2.7 million since 2000” (Richter 2013).
Where is the fair game now? The homosexuals have the chance to move faster up the notice scale into this private organization, however if this ban is continuous, then more will leave. If man is supposed to be equal and the Scout is supposed to be a model to the youth, then this organization is teaching your future generations to be prejudice; homosexuals or anyone is meant to be equal.
            Unprofessional-role-models are homosexuals in the words of the Boy Scouts of America, however, times are changing, attitudes are mixed, and the people of the United States are fighting for equality for homosexuals and all. Before you as a person fights for fairness as what Dale and also the Irish-American Gay, Lesbian and Bisexual Group of Boston (1995) fought for, you must first look into the beast of the BSA.  The Scouts and the governments’ ethics and laws are very-sly, using words or meanings that focused on other groups, blaming more than fixing or allowing, “And would-be Scouts who are gay or religious nonbelievers are left out in the cold by two venerable American institutions- the legal system and the Scouts”(Hills 2013).  If the writers’ intentions were that the cold environment was like the Scouts and governments hearts, then, agree because if you live in a country that only looks to profit or self-gain, then, you are living in Hells blizzard. The bitterness and sorrow of the groups suffering from this discriminatory action is most unfair and inhuman.  Today, mess is forming pressure on the BSA, groups fight against them and even political members in congress and senate fight against the hate: American Civil Liberties Union (ACLU), President Barack Obama, and even Texas Governor Rick Perry.  Luckily these supporters want the ban lifted, from Texas in a small town called Irving were delaying ban discussion. However, many parents want it to end as well; Scouts are leaving the private organization, due to this rage in parents, joining organizations to fight the ban, such as the ACLU. Members of the organization wanted a voice heard, because if your “morally straight,” doesn’t mean your life stays consistently “moral:” “Zach Wahls, an Eagle Scout who has two lesbian mothers and is the founder of Scouts for Equality, called the delay “an abdication of responsibility”” (Richter 2013). Thank you, others in the organization understand the ban in an equality basis. Though, so many do not understand the chances to change the United States as a whole; small steps like this paper or this young man’s willingness to start a program for equality, is only the beginning. Things are moving fast in this period now, ideas become actions for organizations, and finally, homosexuals are getting fewer limitations because of this; funny thing is, this is happening not just in the BSA, that’s just a smaller portion.
            Watching the hypocrisy of this private organization, make others sick to their core, even though the constitution allows these organizations to decide acceptance; once heard before in the Boy Scouts of America v. Dale (2000).  Knowing that the BSA has an oath of acceptance for a new youth army, many feel that the organization only wants money wielding prejudice fighting Christians for the standing army.  Parents of some of many organizations attached to the private organization realize change and fear homosexuality will poison the youth and society, “ “Must not allow these young minds to be poisoned by the “G” word in the Scouts Oath: “ On my honor I will do my best, To do my duty to God and my country….”(Emphasis added)”(Jasper 2013). So to the charge earlier, that homosexuals are pointed at as non-role-models of this country in the BSA, now, they are pointed as poison in the apple; as before, attitudes don’t change but opinion can, so deep down, change should be severe. Reading this as a man/ woman of great intellect, can you not see the hypocrisy of this nation: a nation of equality for all? Equality needs voices, equality needs ideals, and equality needs the chance to accept; through the blizzard from earlier, equality is your only word to use to fight the youth/ men in uniform. Unfairness is a other word, that flows softly through the cracks of the organization, however, it’s a word that is most fowl due to its existence in the Scouts oath; the only way to flow homosexuals into the private organization, is that if the oath is re-wrote in terms of acceptance of homosexuals- not being so strict, but it’s a reason of tension in the BSA.  It will fall into the pressure bubble, created as the oath was written in 1910, a ruin in the middle of the organization may crack, and letting an overflow of unfairness- letting the BSA see the monster within.
            Another main cause in this battle for homosexuality in the BSA is the 1st amendment (expresser of the people’s equality). If the other causes, including: unfair-role-models, sexual racism, and the mixed feelings of the public (inhuman hypocrisy), then, the 1st amendment is the glue to hold the mess for the BSA. In the 1st amendment:
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise therefor; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievance”(Ginsberg A15).
This is the glue, it’s the countries frame for democracy, and however, it is the warping factor the BSA uses to express certain ideals.  In the beginning of the BSA, the dream was to create a structured system for the youth of America, but everyone is expressed differently and one cannot just form an cloned system of believe. So, they created an oath and laws to subject certain beliefs one has, such as believing in God and being “morally straight.” Blocking further action of the homosexual community to move, though, “grievance petition to government” is still an action, holding in place today in another case for gay-marriage and for the BSA to rid of ban on the homosexual community. You’re not saying it fair, but due to the case between Dale and the BSA, Dale lost because of his oath, an oath he should have taken more to heart before moving on in the program; you just see the injustice of equality in the world and the private organizations. Knowing if this glue is a monster, it is also a fundamental creation from our founding fathers, meaning the BSA isn’t evil, but needs correction in their ideals for the future America.
            In a country, you have states following by complex rules and laws to control populations, including either straight or homosexual people, allowing a “certain group” to excel more than the other. How long can you stand by and watch the word equality burn, because others are tired of smelling the smoke in the air. As Dale did after the battle, he moved on with his life, continuing his proud path of homosexuality; he may not be the “morally straight” male they wanted in the oath, but he is a man proud of his values and beliefs. And Zach, saw the future coming fast and began a system of fairness for both homosexuals leaders and youth- attacking the unfairness monster of the BSA.  Did the Scouts actually teach values to Dale and Zach? Did it teach them to choose the correct path; telling them to leave that old system and to create a new one? Yes, in all of this talk of equality has been derived to a new path rather than explain the acceptance of homosexuals in the BSA.  The Scouts of America is not a terrible system, learning from current friendships, that they feel about this as a new step in the private organization. Their attitudes plain, even knowing everything about Scouts: their oath and laws have been their life, but still look into the future. For the people who look towards only straight youth/ adult organizations, look into your hearts and see that the BSA with many other organizations cannot be poisoned by homosexuality.  The future is the future; this country cannot look past equality and whisper behind its burning back.  You are all human, let the right to choose be intimate, let the right to choose be enlightening, and let homosexuality in the Boy Scouts of America. Finally, after years and years of fight for acceptance, homosexual young men are allowed into the Boy Scouts of America; however, they do not accept homosexual leaders into this organization- by the tactic of small changes. Now this generation will make a difference in making the organization the tree to multiple branches; to spread equality to all who deserve it.
