POCSO Act Important Judgements Supreme Court of India

Here are some of the important judgments of the Supreme Court of India on the Protection of Children from Sexual Offences (POCSO) Act, 2012:

  • In the case of Nawabuddin v. State of Madhya Pradesh (2019), the Supreme Court held that the POCSO Act is a special law and, as such, it takes precedence over any other law. This means that the provisions of the POCSO Act will apply even if they conflict with the provisions of any other law.
  • In the case of Arti Devi v. State of Uttar Pradesh (2022), the Supreme Court held that a 13-year-old boy’s assertion that the accused did “Gandi Harkat” is sufficient to issue process under Section 204 of the Code of Criminal Procedure (CrPC). This means that the police can file a case against the accused even if the boy is not able to give a detailed description of the sexual assault.
  • In the case of State of Maharashtra v. Satish Raghde (2022), the Supreme Court held that the accused can be convicted under the POCSO Act even if there is no skin-to-skin contact between the accused and the victim. This is because the POCSO Act defines “sexual assault” to include any act that “has the sexual intent” and “causes or is likely to cause” the child to “suffer from sexual abuse”.

These are just a few of the important judgments that have been passed by the Supreme Court on the POCSO Act. These judgments have helped to clarify the law and ensure that children are adequately protected from sexual abuse.

The court held that the exception in the Indian Penal Code (IPC) for marital rape does not apply to minors, emphasizing the importance of protecting the rights of children.
  2. Nipun Saxena v. Union of India (2019): This case dealt with the issue of the death penalty for the aggravated sexual assault of minors under the POCSO Act. The Supreme Court held that the imposition of the death penalty should be left to the discretion of the trial court and that the judiciary should not interfere with the legislative policy expressed in the POCSO Act.
  3. State of Madhya Pradesh v. Anoop Singh (2015): In this judgment, the Supreme Court clarified the definition of “penetrative sexual assault” under the POCSO Act. The court held that for an offense to qualify as penetrative sexual assault, there must be a direct physical contact with the private parts of the child or the child’s body, and mere intention or preparation is not sufficient.
  4. Sakshi v. Union of India (2018): This case focused on the issue of child-friendly courtrooms and the importance of protecting child victims during the trial process. The Supreme Court issued guidelines for the establishment of child-friendly courts and the training of judges, lawyers, and court staff to handle cases under the POCSO Act sensitively.
