DPIIT to seek approval for Amendment of Provisions Bill, 2022
According to officials, the Ease of Doing Business and Ease of Living (Amendment of Legislation) Bill, 2022, which decriminalizes minor offenses by rationalizing related provisions under various ministries to ensure ease of doing business, will be submitted to the Cabinet for approval. The measure has been finalized in conjunction with industry stakeholders, and the DPIIT plans to propose it during the upcoming winter session of Parliament, they stated.

In order to lessen the load on the judiciary, this measure proposes to rationalize about 110 provisions among 35 Acts that are governed by 16 ministries or departments.
The measure aims to decriminalize incarceration provisions pertaining to petty offences and inconsequential procedural infractions from 35 Acts, an official told the news agency PTI. This one measure contains amendments to about 110 such clauses. Although the agency has noted that these rules have not frequently been used, there is nevertheless concern within industry about them. The intention is to substitute fines or gradated punishment for imprisonment.

The Legal Metrology Act of 2009, the Government Securities Act of 2006, the Trade Marks Act of 1999, the National Housing Bank Act of 1987, the Air (Prevention and Control of Pollution) Act of 1981, the Patent Act of 1970, the Pharmacy Act of 1948, and the Indian Forest Act are among the 35 Acts mentioned above.
Some of these proposals include removing the six-month maximum sentence for trespassing, permitting cattle to trespass in forest areas under the Indian Forests Act, and compounding offences for failing to apply for registration and operating a vehicle without a permit under the 1988 Motor Vehicles Act. Others include removing the one-year prison sentence and increasing the fine from Rs 5,000 to Rs 25,000 for failure to file returns, failure to maintain records under the Legal Metrology Act of 2009, and failure to comply with orders restricting or controlling the import or export of marine products under the Marine Products Export Development Authority Act of 1972.
