Let’s look at tips from the experts…

CBD cosmetics and compliance in Europe and the UK

European cosmetics regulations are subject to this Convention, making its standards applicable to cosmetics. As a result, cosmetics regulations in the UK are also affected, as they follow European regulations for the time being.

However, EU member states are allowed to interpret the legislation, resulting in a myriad of national provisions. Harmonisation is also envisaged, but brands must comply with national requirements for the time being. Europe, for example, prohibits the use of certain varieties of cannabis authorised at the European level, while the maximum THC content differs.

The main difficulty in achieving compliance is the presence of different levels of legislation: Europe, non-member countries and national provisions, and then the United Kingdom, which could stand out in the future. In addition, the European Commission is planning to ask the SCCS to officially verify the safety of CBD in cosmetics, following the concern expressed by several Member States that the level of cannabidiol in certain products is too high. Therefore, a tightening of regulations (including the authorised level of CBD) is expected in the European Union.

In summary, the main points to bear in mind for compliant labels and formulas are as follows:

  • Regulations at European Union level (including those to come) versus member/non-member country level
  • The quality of the cannabis plant, THC levels and authorised cannabidiol varieties
  • Toxicological evaluation of the CBD ingredient, in accordance with Article 3 of the EU Cosmetic Regulation
  • Communication and marketing focused on CBD and not THC (or cannabis)

This last point is of the utmost importance, as THC is a drug, and it is therefore illegal to advertise it by implying that CBD has the same properties. Cosmetics brands, therefore, do not have the right to confuse CBD and THC as part of their marketing strategy, including the development of claims.

Furthermore, the marketing of CBD remains complex because its legalisation in the EU/UK does not prevent it from being banned from advertising by the GAFAs. Some payment platforms may also prohibit the sale of hemp- or cannabis-related products.

Therefore, CBD cosmetics development must be carefully planned to avoid non-compliant formulas or labels.

Good to know: it is the same for CBD products that you can buy online. Selecting the best CBD supplier, such as JustBob.shop, is the only way to have the best CBD product at the best price!
