Prayagraj, Legal Correspondent. The Allahabad High Court has reserved its decision on the appeal against the cancellation of PCS Preliminary Examination 2021 by a single bench. The single bench had canceled the result of the preliminary examination for not giving five per cent reservation to ex-servicemen. Along with this, the Uttar Pradesh Public Service Commission has been ordered to release the result afresh, which has been challenged in the appeal.

The order was given by a division bench of Chief Justice Rajesh Bindal and Justice JJ Munir. It was argued on behalf of the commission that the notification regarding reservation for ex-servicemen was issued after the last date of submission of application. Therefore, reservation cannot be claimed.

It was said on behalf of the petitioner that the notification issued on March 10 is an amendment of the law and not any new law has been made. The old Act is the Uttar Pradesh Public Service Commission (Reservation for Physically Handicapped, Dependents of Freedom Fighters and Ex-Servicemen) Act 1993. Through amendment in 1999, Group B was excluded from the category of reservation.

This decision of the government was challenged in the Allahabad High Court. In compliance with the order of the High Court, the government made arrangements for horizontal reservation for ex-servicemen on 10 March 2021. This notification has been implemented from the day it is issued. It was said that despite the order of the High Court, the Public Service Commission is conducting the interview, which is in defiance of the order. The court has reserved the decision after hearing both the sides.
